National Niche Following the initial 60-day freeze on Federal Land Drilling Permits issued in January, the Biden administration has issued an Executive Order on Tackling the Climate Crisis at Home and Abroad, which expands upon the Department of the Interior’s Secretarial Order No. 3395 and indefinitely suspends the federal oil and gas leasing program. This new order halts any new oil and gas auctions on federal land and water, to the extent consistent with applicable law, as the President’s administration reviews the program. The Executive Order is not expected to affect existing oil and gas operations under previously authorized federal oil and gas leases. Many larger producers have stockpiled permits and it could take several years before the full effects of the moratorium become evident. The administration’s review of the federal program is to be conducted in consultation with the Secretary of Agriculture, the Secretary of Commerce, through the National Oceanic and Atmospheric Administration, and the Secretary of Energy. Under consideration will be potential climate or other impacts of current federal oil and gas permitting and leasing practices and whether to adjust royalties associated with the federal oil and gas leasing program or take other appropriate action to account for corresponding climate costs. ******************************************************* A set of bills has been introduced in Congress aimed at reforming regulations on Federal oil and gas leases. One bill seeks to increase royalty rates on Federal lands to 18.75% from the existing 12.5% and would also increase the minimum bid price for Federal lands from $2.00 per acre to $5.00 per acre. Another bill would set targets to reduce methane emissions from 2012 levels by 65% by 2025 and by 90% by 2030. ******************************************************* A bill was introduced in the U.S House of Representatives on April 8 by Teresa Leger Fernandez of New Mexico. This bill would authorize $8 billion to plug and clean up abandoned wells nationwide, providing $7.25 billion in grants for well cleanup on state and private lands and $700 million for plugging on public and tribal lands. The bonds for wells on a single lease would increase from $10,000 to $150,000 and bonds for all of a company’s wells in a state would rise from $25,000 to $500,000.
