Alternative Dispute Resolution: Any payment disputes or discrepancies shall be resolved through mediation or arbitration, as specified in the contract. Both parties agree to participate in good faith and abide by the decisions made through the chosen dispute resolution process. Client Cooperation: The client shall promptly provide any necessary documentation, approvals, or information required for invoice processing and payment. Delays caused by the client’s failure to cooperate may result in adjustments to project timelines and payment schedules. Non-Assignment of Payments: The client shall not assign or transfer any payments due to the AEC firm to any third party without the prior written consent of the firm. Any unauthorized assignment or transfer shall not relieve the client from their payment obligations. Remedies for Default: In the event of default by the client, including failure to make timely payments, the AEC firm reserves the right to pursue all available legal remedies, including the recovery of outstanding payments, interest charges, legal fees, and costs incurred in the collections process.
