THE DAILY DRIVER Attorneys Defending Your Right to the Road

JULY 2022

I SHOW MY GRATITUDE FOR OUR COUNTRY EVERY INDEPENDENCE DAY

As we approach Independence Day, I can’t help but feel grateful for our country and our freedom. My family and I enjoy looking back at the events that helped us gain our freedom, like the signing of the Declaration of Independence and our Founding Fathers’ sacrifices to help those in the 13 colonies. Our Founding Fathers put everything on the line for us — they pledged their lives and fortunes when they signed the Declaration of Independence and rebelled against the greatest military country in the world. Nine of the 56 signers fought and died in the American Revolution, lost their sons during the war, or were captured. They knew the risks of rebelling against British rule, but they were willing to do it — for our freedom. The pledge our Founding Fathers took is the same pledge our military makes when they join. They make this promise for us so we can keep our freedom. My uncle and father served in the military, so I had firsthand experience of how seriously they take their pledge. I will forever be grateful for the sacrifices our armed forces make every single day.

America is a melting pot of different cultures, backgrounds, and beliefs. We aren’t always going to agree with each other, and that’s okay. We can disagree with one another and have civil conversations about different topics. People in other countries do not have this same privilege. Even though we have our differences in the U.S., we all have one thing in common — freedom. I remember not too long ago being in Michigan to celebrate the Fourth of July. I was in Bay City, surrounded by thousands of people. Even though the fireworks and the food were terrific, something larger pulled us all together; we were all celebrating America and our freedom despite our differences. We all shared familiar feelings of patriotism. To our armed forces, thank you for putting your life on the line for us every day. Your bravery does not go unnoticed. Happy Independence Day, everyone! I hope you and your family have a happy and safe holiday.

“Even though we have our differences in the U.S., we all have one thing in common — freedom.”

Because of their bravery and courage, we are allowed to travel, be with our community and loved ones, and celebrate the Fourth of July with fireworks and food. The rights and freedoms we have as individuals separate America from the rest of the world. America has the right to free speech and religion when most of the rest of the world doesn’t. We have the right to make our own choices. We are free to go where we want and say what we think — no one else is ultimately responsible for our success or failure. If you look around the world, this kind of freedom doesn’t exist in other nations to this degree. Other countries can take away rights in a blink of an eye. Our Founding Fathers understood the importance of freedom and wanted to ensure American citizens always had this human right. Even when you aren’t happy with something the government does, you have the freedom to voice your opinion and converse with others about it. We don’t have to have the same viewpoint on topics — we have the freedom to think for ourselves and develop our own ideas.

A Round of A-Paws

This Amazing Pup Saves the Day — Twice!

Heroes don’t always wear capes or stand on two legs — and in a specific case with a German shepherd, this is exceptionally true! A dog noticed that one of his favorite tiny humans was in some serious danger, so he saved the day, two times! A little boy and girl enjoyed the day, tossing a ball back and forth in their backyard. When the girl overthrew the ball, it unfortunately fell into a small pond behind the boy. The girl rushed inside the house to get help, but the boy stayed outside and even ended up leaning over the edge of the pond as he tried to retrieve the ball on his own. This is when a protective German shepherd, lying nearby in the grass, saw everything and immediately sprung into action.

The dog first looked into the pond to locate the ball. Then, knowing the boy was in danger as he teetered on the edge, the dog tugged on the little boy’s vest with his teeth, pulling him backward to safety near the back patio of the home. Once the little boy was in a safe location, the dog located a pole net that had been leaning against the house and brought it over to the pond. While his tail wagged with pride, the dog fished the ball out of the pond. The dog then put the net down on the ground near the pond and brought the ball over to the boy, who petted him with appreciation. This German shepherd saved the day for this little boy and girl — and also saved the boy from injury and needing a dry set of clothes! What an

amazing canine. He deserves a treat and a round of a-paws!

KNOW THE 3 MAJOR OFFENSES What Offenses Lead to Driver Disqualification?

If you get pulled over and receive your first serious offense , a traffic court judge will fine you, and the DMV will assess how many points you receive. However, getting your second conviction within three years of your first offense will be counted as a disqualifying offense. You will receive a 60-day driver’s disqualification. A third offense will result in a one-year driver’s disqualification.

For example, if a driver’s cell phone is resting on top of their shipping documents and they pick it up to get something else, some CHP and law enforcement officers could issue you a ticket for illegal phone use. Some believe that simply holding your device is subject to violation. After all, the code says “ ... while holding and operating …” 3 — UNSAFE LANE CHANGE An unsafe lane change is when a driver changes lanes before it is safe to do so or hasn’t signaled for a continuous 100 feet to warn other drivers. But sometimes, drivers have to make quick decisions and sudden lane changes if other drivers around them are driving recklessly. You probably have had to do this while driving. Not all lane changes are unsafe, even when they do not meet the objective of the law laid out in CVC. If you have traffic citations for any of these offenses, allow Bigger & Harman to assist you. We are experienced traffic attorneys who know what to look for and what to say during court. If needed, we can often pull up live video recordings to show how to word an objection. CMV drivers can also receive an initial consultation for free without obligation. So, give us a call today. We will be happy to look at your case and see if we can challenge the conviction.

Three serious offenses will lead to a driver disqualification.

1 — FOLLOWING TOO CLOSELY This is one of the most frequent CMV serious offenses that will lead to disqualification. Unfortunately, most of these offenses are out of the truck driver’s control. If a car pulls out in front of a big truck and brakes, the truck driver may not have enough time to slow down — leading them to follow too closely. A law enforcement officer may not have a good view of the road and could issue the truck driver a ticket even if another vehicle pulled out in front of the big truck. 2 — ILLEGAL PHONE USE The CA Vehicle Code (CVC) states, “A person shall not drive a motor vehicle while holding and operating a handheld wireless telephone.” But this offense might be subjective depending on the viewpoint.

While it’s unfortunate for any of us to receive a speeding ticket, it’s even more difficult for our commercial truck drivers. Navigating your way through the court system or informing your employers about the incident is stressful. Luckily, you don’t have to do it alone. If you get a speeding ticket, you should immediately hire a traffic attorney. WHY DO I NEED A TRAFFIC TICKET DEFENDER? You need a traffic attorney for the same reasons you can’t take a day off work to spend time with your loved ones — time and money. If you take a day to miss work to go to court, that could mean missing a load, which means losing hundreds of dollars. You will also have to tell your employer you have to miss work because of a traffic ticket, including if you are convicted or have to pay a fine. Missing your load will not put you on good terms with your fleet manager, and if the company is a one-person operator, they may not have enough money to cover the days you’ll be in court. On top of this, many commercial drivers only consider the fine of the citation, not the loss of income, higher insurance, or possible job loss. A judge may not even get to hear your case the day you come to court, so you may be out of work for several days in order to plead your case. But ALLOW US TO DISPUTE IT Don’t Fight a Speeding Ticket Alone

The Benefits of a Digital Detox.......................... PAGE 4

Is It Time for a Digital Detox?

When you need a break from your busy life, you probably look at your cellphone. And when you need a break from your cellphone, you might watch TV or browse social media on your other devices. This cycle of never-ending screens can be taxing on your mental health. Everyone hits their breaking point at a different time, and you may not even realize when you’ve reached your limit. If you find yourself getting angry or upset at posted content, consistently comparing yourself to others, or feeling depressed, it may be time for a digital detox. But what is a digital detox? It’s taking a break from electronic devices, such as your cellphone or tablet, and mindlessly scrolling through social media or news stories.

Another benefit is that you’ll feel less stressed, especially if you compare yourself to others on social media or get lost in negative news cycles. Perhaps the most notable benefit of a digital detox is reclaiming your own time. Checking your cellphone and scrolling through social media can quickly become a subconscious habit. Before you know it, an hour or two has passed. Even watching television

can take up huge chunks of your day. With a digital detox, you get that time back, and you can reallocate it to healthier activities. If you feel like you need a break from your electronic devices, take one. It could lead to a healthier and happier life.

Now that you know what it is, how can you detox yourself?

• Schedule a break from your devices. Even if it’s just for a half-hour, use the time to do other activities, such as exercise, household chores, or even gardening. • Turn off notifications. Constant notifications can be incredibly distracting, so silencing them allows us to focus more on our surroundings. • Disconnect before bedtime. Turn off all electronics an hour before you go to sleep to relax your body and mind.
