New York Paid Family Leave

The state of New York mandates Paid Family Leave (PFL) for all employees working in New York State. An employee must be employed full-time for 26 consecutive weeks or part time for 175 days to qualify for this benefit. The 2023 benefit is equal to 67% of an employee’s average weekly wages, up to a maximum of $1,131.08 , for a duration of up to 12 weeks. If you are eligible for Paid Family Leave, you pay for these benefits through a small payroll deduction equal to 0.511% of your weekly wage. In 2023, these deductions are capped at 0.455% of the New York State Average Weekly Wage, a maximum annual contribution of $399.43.

PFL is job-protected paid leave to:

⮞ bond with a newborn, adopted or foster care child during the first 12 months; ⮞ care for a seriously ill family member; or ⮞ address important needs related to a family member’s military service.

Please note: PFL is NOT available for an employee’s own serious health condition or qualifying military event.

Paid Family Leave only begins after birth and is not availablefor prenatal conditions. A parent may take Paid Family Leave during the first 12 months following the birth, adoption, or fostering of a child.

Caring for a Close Relative with a Serious Health Condition A close relative includes: ⮞ Spouse ⮞ Domestic partner ⮞ Child ⮞ Parent

⮞ Parent-in-law ⮞ Grandparent ⮞ Grandchild

A serious health condition is an illness, injury, impairment, or physical or mental condition that involves: inpatient care in a hospital, hospice, or residential health care facility; or continuing treatment or continuing supervision by a health care provider.

For example, you need one or more full days to care for your mom when she undergoes chemotherapy; or your dad is having surgery followed by extensive recuperation; or your child is undergoing intense psychotherapy and is unable to attend school for a period of time. You can take Paid Family Leave in these types of instances. Active Duty Deployment Paid Family Leave is available for families eligible for time off under the military provisions in the federal Family Medical Leave Act when a spouse, child, domestic partner or parent of the employee is on active duty or has been notified of an impending call or order of active duty. Cosmetic treatments (such as plastic surgery) are not eligible conditions unless inpatient hospital care is required or complications develop. Ordinarily, unless complications arise, the common cold, the flu, ear aches, upset stomach, minor ulcers, headaches other than migraine, routine dental or orthodontia problems, periodontal disease, etc., are examples of conditions that do not meet the definition of a serious health condition. They would not qualify for Paid Family Leave.
