WORKERS’ COMPENSATION AND COVID-19 KNOW YOUR OPTIONS IF YOUR JOB PUTS YOU AT RISK

If you’re in an essential line of work that has been deemed necessary during the coronavirus pandemic, there’s no denying it: You may be putting your health at risk every day in order to fill an important role that your community needs to continue functioning. In Florida, a state of emergency was issued by Gov. DeSantis in early April, after which the chief financial officer of our state enacted a directive that provides workers’ compensation coverage to public servants on the front lines of COVID-19. What this means is that if you contract the virus while performing work that’s been deemed essential and necessary, under Florida law, you may qualify for insurance under workers’ compensation. While the “front lines of COVID-19” leaves room for interpretation, the group these directives most clearly point to are those in emergency and health services. Doctors, nurses, paramedics, and other health care workers who are interacting with those infected or potentially infected could be at higher

risk for contracting the virus. But Florida statutes require an employer “to provide workers’ compensation coverage if the employee suffers a compensable injury arising out of work performed in the course and scope of employment.” It’s possible that the range of this law could reach further than just the medical fields, so if you think the work you do has caused you or a loved one to contract COVID-19, you may have a valid claim to file in order to receive workers’ compensation. Doing so could help you pay your medical bills and gain compensation for other possible damages as well.
