Technology’s Effect on Advocacy
Your chosen platform should not stop at searchable text; it should also be built to interpret the non-text record so the data locked inside a graph, a monitor strip, or a handwritten note is surfaced rather than skipped. Under a tight discovery deadline, with a demand letter due and a deposition to prep, that gap is where cases lose ground; not because the facts were not there, but because nobody, or nothing, had time to find them. Any platform built to close that gap also must be built to handle what is inside of it. Ensure HIPAA compliance and a closed-environment handles those records as a baseline requirement. This cannot be an afterthought, given how sensitive the material is.
a human reviewer would eventually find given unlimited time and doing it fast enough that the attorney can act on it while it still matters. The output still needs a lawyer's eyes. What changes is how much ground that lawyer can cover before they apply them.
Where the Impact Is Being Felt Right Now
This is not a future-tense conversation. Plaintiff firms are already using agentic workflows across several stages of complex litigation. In medical chronology work, agentic tools are condensing records that would take a paralegal days to organize into structured, litigation-ready timelines, while flagging treatment gaps and inconsistencies for attorney review rather than simply presenting a clean summary. In negligence and liability review, particularly in nursing home and elder abuse matters, agentic systems can cross-reference facility records, staffing patterns, and regulatory standards to identify where the standard of care may have broken down. Discovery preparation is another area of visible change. Instead of an associate manually drafting every interrogatory response and objection from scratch, agentic tools can generate a first pass grounded in the actual case file, leaving the attorney to refine rather than start from a blank page. The same logic applies to demand letter drafting, where the tool pulls from the specific facts of the matter rather than a generic template, and to deposition preparation, where agentic review of prior testimony and records can surface the exact page and line an attorney needs without a manual re-read. The common thread across all these applications is that the technology is doing preparatory reasoning, not making legal decisions. It narrows what a human
What Agentic AI Is, Why the Distinction Matters
"AI" has become a catch-all term, and it is worth separating what plaintiff firms are actually being offered. Basic AI search tools find documents that match a query. Document automation fills in templates faster. Neither one reasons about the case. Agentic AI is different in kind, not just in degree. Rather than waiting for a single instruction and returning a single output, an agentic system can break a task into steps, pursue each one, and adjust based on what it finds. Ask it to review a medical record set for evidence of a care gap, and it does not just return keyword matches. It can read across providers, flag where treatment stopped and should have continued, cross- reference that gap against the timeline of a reported fall or injury, and surface the inconsistency for the attorney to verify. That last step matters. Agentic AI is not a replacement for legal judgment, and any firm evaluating these tools should be skeptical of claims that suggest otherwise. The value is in surfacing what
