How Dramatically Would Things Have Changed? By Roger Dreyer

Now that we are on the other side of the Uber Initiative Battle, I thought it would be instructive to take a shot at looking into the near-missed future. What if we were not successful in that battle, and the Uber initiative had passed? Just how dramatically would things have changed? Our membership would have been devastated, our clients and future clients would have been robbed of justice, and a green light would have been given to all the insurance carriers, tech companies, and bad actors to lay waste to us after such a terrible defeat. If that had happened, it is likely that just 8 years from now, the civil justice system as we know it would have been ripped to shreds. Law offices gone, and people with nowhere to turn to for help. Clients unable to access courts, and lawyers no longer able to take cases. It would have happened if lawyers had given up and sat idly by while tort reform encircled them; if, rather than facing the threats, they had tried to carry on with business as usual. Meanwhile, Meta, AI, crypto bros, and billionaires flooded election after election with money for corporate candidates with no one standing up for the civil justice champions. By the

time the lawyers would have wanted to react, it would have been too late.

We have seen a glimpse into the future and what would have happened. The line between that future and our reality is paper-thin if we do not mobilize NOW to defeat big tech and hostile, big business interests threatening this election cycle. Make no mistake, our clients’ rights are still at risk of being eviscerated. All Californians depend on CAOC members and our advocacy team to protect their access to courts. Fortunately, CAOC has the strategy to help our candidates win (yes, even in the face of Meta, AI, crypto bros and billionaires) – but we cannot do it alone. Step in now: Commit to engaging your trial lawyer community. Spend your time educating lawmakers through our Grassroots program.

We can change the outcome of the future for the betterment of our clients and ourselves. Ballots for the 2026 November election arrive soon, and voters will decide the future of the legislature in 30 days. We have the ability to look ahead 300 or 3,000 days and make it a future that protects the people of our state and their ability to seek justice.
