Two new CIPP consultation responses are available to view Published: 20 July 2023 Emailed: 26 July 2023
There are a lot of consultation currently going on, and with the government going into recess it has given us a lot to think about while they are on the break.
The CIPP policy team has been busy responding to a selection of these consultations. Two more are now available on our consultation responses page in the policy hub for members to view:
The tax administration framework review: creating innovative change through new legislative pilots
This consultation explores allowing ‘sandboxes’ which would give employers the ability to trial and test upcoming changes. This would allow testing to be done alongside normal processes as they actually happen and for HMRC to receive valuable feedback based on experience rather than estimations on how things could work.
The CIPP are broadly in agreement that this would be beneficial, but have raised some points around how it is implemented and incentivised.
Retained EU employment law reforms
As we start to implement laws and regulations into UK statute there are areas that could be changed now EU law does not need to be accounted for. As a continuation of previous consultations, this one asked a number of questions around holiday pay, namely allowing the use of 12.07% or similar percentages to roll up holiday pay. There is much to consider here and this is likely to carry on for some time until a satisfactory solution can be implemented. The CIPP really wants to highlight the need for adequate guidance and assistance for employees and employers in this area to make it a success.
In addition, there are potential changes to TUPE rules for smaller businesses.

Consultation: Occupational Health: Working Better Published: 28 July 2023 Emailed: 2 August 2023
The Department for Work and Pensions (DWP) has opened the new consultation ‘ Occupational Health: Working Better ’, on 20 July 2023. This consultation seeks views on proposals aimed at increasing employer use of occupational health (OH) services. Tackling economic inactivity due to long-term sickness is a top priority for the government. The government intends to obtain views on establishing an agreement and partnership between government, employers and OH providers, to help drive an ambitious increase in OH coverage, specifically in relation to: • the introduction of a national ‘health at work’ standard to help provide a baseline for quality OH provision including guidance, the option of pursuing accreditation and additional government-funded support services as well as employer best practice sharing • best practice from other countries and other UK-based employer models that enable employers to provide support for their employees • developing work and health workforce capacity through new service models, building the skills mix and diversity of the current workforce and partnering with the private sector to develop a long term sustainable multidisciplinary OH workforce.
