• An NOV is the most formal type of enforcement action. It is appropriate for: • A serious regulatory or statutory violation; • Non-response to PNOV or less formal enforcement mechanisms; or • Repeated violations of the same type.

• The violation is serious, repeated and/or continuing in spite of previous informal actions. • The violation appears to present an imminent and substantial hazard to human health or the environment or the property and assets of the Tribe. • Suspected significant violations of prior administrative orders • Failure to report violations when required by law. • Failure to pay civil charges. • Failure to take timely and appropriate required action.
