Surveillance Liabilities: Reporting
Reporting is sometimes the only exposure that some stakeholders have to Surveillance. Reports can create a liability if they: • present information is not accurate • lack continuity (names, word tenses, time/date formats, etc.) • use subjective/opinionated wording (conclusion words) • make statements that are not supported (by footage or other documents) • are not completed in a timely manner

Surveillance Liabilities: Retention Spoliation of evidence is when someone with an obligation to preserve evidence (footage) either neglects or intentionally fails to do so. Prevention measures can include: • Retention and evidence policies • Include evidence categories; “working” and “best” • Consider standards for footage retained/incident type • At a minimum, retain footage of subject(s) from the time they enter retained view(s) until they leave. • Review standards/processes with internal Legal and Risk Management teams. • Consider similar review with LEA and/or applicable Court.
