Company fined for fatal accident

Roger Cousineau died in the accident March 2, 2011 when he beca m e pinned between two m etal bins knocked over b y a forklift at the Sanilit site on Sandfield Drive. The fir m was found guilt y of failing to provide infor m ation, instruction and supervision to a worker on the dangers of

working in the y ard where there is vehicu- lar traffic. The fine was i m posed b y Justice of the Peace Linda Leblanc. In addition to the fine, the court i m posed a 25-per-cent victi m fine surcharge, as required b y the Provincial Offences Act. The surcharge is credited to a special provincial govern- m ent fund to assist victi m s of cri m e. The accident occurred when the victi m

was in the y ard m easuring an e m pt y con- tainer. The container was third in a row of four. As the worker was taking m easure- m ents, a second worker used a forklift to retrieve the first container in the row. This caused the other containers to bang up against each other. The victi m ’s head was caught between the third and fourth containers and the worker died of severe head trau m a.
