Judge Upholds Oregon EPR Law In Federal Case With NAW Oregon’s Plastic Pollution and Recycling Modernization Act (RMA), which establishes a statewide extended pro- ducer responsibility (EPR) program for packaging, has been upheld in federal court. The law was challenged earlier this year by the Nation- al Association of Wholesaler-Distributors (NAW), which alleged violations of the U.S. Constitution’s Dormant Commerce Clause and Due Process Clause. Oregon De- partment of Environmental Quality (DEQ) Director Leah Feldon was the lone defendant in the lawsuit. Following a five-day bench trial at the U.S. District Court for the District of Oregon in mid-July, Judge Michael H. Simon’s 71-page ruling determined there were no consti- tutional violations. “Oregon has been a pioneer in waste prevention, re- use and recycling legislation for more than half a century,” the ruling states, adding that the state adopted the coun- try’s first bottle bill in 1971. “With the RMA, Oregon contin- ues to show innovative leadership toward solving serious local, national and even international problems caused by plastic and other forms of waste and packaging pollution.” Simon notes that the RMA, which was passed in 2021 and became the first active EPR program in the country when it launched July 1, 2025, is designed to shift end-of- life costs of a product onto its producer. “Stated another way, EPR laws are intended to ensure that, among other things, the prices charged for products include their hidden or unintended costs, rather than force third parties to deal with the total cost of placing a product into the stream of commerce,” Simon writes. “In economic terms, this is known as requiring that the price of a product reflect, or internalize, its ‘externalities,’ which are costs (or benefits) borne by third parties who did not directly partic- ipate in the manufacture, distribution, sale or purchase of that product. NAW says it “strongly disagrees” with the court’s deci- sion, though it was prepared for the outcome.
