الأبعاد الدينيةفي الممارسة الدستورية الإفريقية Religious Dimensions in African Constitutional Practice * Haroun BA - هارون باه ملخص: تبحـث الدراسـة إشـكالية الأبعـاد الدينيـةفي الممارسـة الدسـتورية الإفريقيـة، وتحلّل محتـوى الدسـاتير والقوانيـن الأساسـية والأشـكال المختلفـةفي الصياغـة الدسـتورية، وتحـدّد صلتهـا المباشـرة والضمنيـة بالدّيـن والتديـنفي إطـار ضبـط الحيـاة العامـة، وتس ـيير ش ـؤون الدول ـة وتنظي ـم المجتم ـع. كم ـا ترص ـد الدراس ـة دور الدس ـتور في تدبيـر الشـأن العـام والنهـوض بالاجتمـاع الإفريقـي، وتسـلّل آثـار النظـام الدينـي إلـى القوانيـن الأساسـية، ومـدى كفايتـه في بلـورة خيـارات دينيـة متكاملـة ومتناسـقة. وتسـتخدم الدراسـة تحلي ـل المضمـون م ـن بي ـن مناهـج أخـرى أداةً منهجي ـة لسـبر تجليـات الأبعـاد الدينيـة في دسـاتير الـدول الإفريقيـة. الأبعاد الدينية، الدستور، إفريقيا، النظام الدستوري، العلمانية. كلمات مفتاحية: Abstract: This study explores the religious dimensions in African constitutional practice; analyses the content of constitutions, basic laws and the different forms of constitutional drafting; and defines their direct and implicit link to religion and religiosity in the framework of regulating public life, running state affairs and organising society. It also delves into the role of the constitution in managing public affairs and advancing society as well as the infiltration of the effects of the religious system into basic laws and the extent of its sufficiency in the formation of integrated and coherent religious options. The study applies content analysis among other methods as a methodological tool to examine the manifestations of religious dimensions in the constitutions of African countries.
