The Montgomery Judgement 2015 Healthcare Professionals have to take “reasonable care to ensure that the patient is aware of any material* risks involved in any recommended treatment and of any reasonable alternative or variant treatments” *Whether a risk is material, or not, is legally determined according to the views of “a reasonable person in the patient’s position”, rather than the views of a “responsible body of medical men”. Additionally, determination of material risk must be assessed on an individual, not generalised, basis.
