Third , because both the same products—Kalshi’s sports-related event contracts—and the same legal question—whether the Defendants’ threatened enforcement of Nevada gaming laws is preempted by the CEA and CFTC regulations—are at issue, assignment to the same district judge is likely to effect a substantial savings of judicial effort. Moreover, it would entail substantial duplication of labor if the actions were heard by different district judges. Relating these actions would conserve judicial resources and would prevent conflicting results in cases with identical legal issues and similar facts.
