3.6 Customer Specific Facilities Construction A) Customer Specific Facilities Construction Service Specification I. Definitions
The uppercase terms used herein shall have the same meaning as are ascribed to the corresponding terms in the Definitions section of the Tariff, unless otherwise defined herein. II. Description of Service Subject to the terms and conditions set out for the Customer Specific Facility Construction Service, TransGas agrees to construct Customers Specific Facilities at the request of the Customer. This is a facility construction service only, and does not provide the Customer with any other Service as contemplated elsewhere in the Tariff, unless the Customer and TransGas executes a TransGas Contract for a designated Service. III. Service Availability This Customer Specific Facilities Construction Service is available to Customers who execute a TransGas Contract and comply with the conditions set out in this Service Specification. IV. Term of Service The term of this Service will expire upon the completion of construction of the Customer’s Specific Facilities, unless earlier terminated in accordance with the provisions of the Customer Specific Construction Service Terms and Conditions (attached). V. Application for Service Application for Service under this Customer Specific Facilities Construction Service Specification shall be in a form as TransGas may prescribe from time to time. VI. General Terms and Conditions The General Terms and Conditions for the Tariff and the provisions of any TransGas Contract for Customer Specific Facilities Construction Service are applicable to this Service Specification to the extent that such Terms and Conditions and provisions are not inconsistent with this Service Specification. VII. Service Specification Terms and Conditions (attached) In addition to the requirements of Clause 6, a Customer receiving Customer Specific Facilities Construction Service is required to comply with the attached Terms and Conditions applicable to Customer Specific Facilities Construction Service
