(c) Customer’s Total Daily Activity will be the summation of the Daily Activity on all Shipper’s Imbalance Account(s). The Daily Activity on Shipper’s Imbalance Account(s) will be the estimated total Energy received into the Account(s) the previous Day plus the estimated total Energy delivered out of the Account(s) in the previous Day divided by 2. (d) Notwithstanding Clause 4.3(c), the minimum Customer’s Total Daily Activity for determining Shipper’s Allowable Daily Tolerance shall be 10,000 GJs, and the maximum Customer’s Total Daily Activity for determining Shipper’s Allowable Daily Tolerance shall be 100,000 GJs. 4.4 Obligation Enforcement In the event Customer fails to comply with Clause 4.3 on any Day, TransGas, in its sole discretion and to the extent necessary to ensure compliance with Clause 4.3, may: (i) Adjust Customer’s current daily Nominations and acquire more Gas to be added into Shipper’s Imbalance Account, or remove Gas from the Shipper’s Imbalance Account, as the case may be; (ii) Settle the difference in quantity by purchasing or selling Gas at the price specified in the TEP Service Specifications; (iii) Cancel, prior to the end of the next Day, all or a portion of any Title Transfer(s) from the Shipper’s Imbalance Account at TEP; and/or (iv) Restrict flows at Points of Receipt and Delivery to ensure compliance. 4.5 Right to Restrict Flows In the event Customer fails to meet the Shipper Balancing obligation, TransGas reserves the right to restrict flows at Points of Receipt and Delivery to ensure compliance. 4.6 Operational Flow Orders (OFO) TransGas may, in its absolute discretion, issue an Operational Flow Order to Shippers requiring them to be within a specified tolerance within a specified timeframe. [See General Business Policies Section II.C.3.] 4.7 Monthly Energy Imbalances The difference between the sum of the daily estimated quantities for the Month in a Shipper’s Imbalance Account and the Monthly actual quantities in a Shipper’s Imbalance Account, the Monthly Energy Imbalance, will be placed in the inactive area of Shipper’s Imbalance Account(s). 4.8 Active and Inactive Areas of Shipper’s Imbalance Account The Estimated Daily Shipper Imbalance, residing in Shipper’s Imbalance Account(s), shall be located in the active area of the Shipper’s Imbalance Account(s). The Monthly Energy Imbalances shall reside in the inactive area of Shipper’s Imbalance Account and shall not immediately be included in Customer’s Opening or Closing Balance. Any imbalance, residing in the inactive area of Shipper’s Imbalance Account(s), shall be prorated over the remaining number of Days in the Month. Subject to availability of
