In addition, we dedicate funds to help support non-profit organizations who utilize croquet as a way to engage people with physical, cognitive and motor impairments.

Jiminy Wicket™ Organization

Croquet is an excellent activity for players, offering health and wellness benefits by keeping participants active, mentally engaged, and connected with people of all ages. The goal of this publication is to help connect all non-profit croquet entities nationwide with a new audience, to help drive membership. Clubs in each state host events at various venues, such as restaurants, community centers, schools, parks, residential communities, and assisted living facilities, often operating on a tight, self-funded and dues-based budget. Additionally, many clubs organize annual fundraisers, donating a portion of the proceeds to local charities, yet lack the resources to promote their efforts. After learning about this work, and the personal story and impactful efforts of James Creasey and his Jiminy Wicket™ Organization —which uses croquet play to improve the lives of individuals with physical and intellectual disabilities—it became clear that a platform was needed to raise national awareness.

No Obligation for Non-Compete: AD&CC, Inc. does not require its vol- unteers or contractors to sign non-compete agreements. They can work for other organizations in the same or similar industries.

1. Sponsorship Payment & Authorization

Purpose of the Payment: The fee you pay for sponsoring your business advertisement goes toward covering costs such as production, printing, shipping, distribution, and postage. This is not a profit-driven fee but an offset for the expenses incurred by the Publisher TouchPoint Consulting know throughout as (TPC) and You the client/sponsor “the Member”. Credit Card Authorization: By signing the insertion form, you authorize the Publisher to charge your credit card for the sponsorship cost plus an additional fee for processing your credit card payment. Payment Due at Insertion: Payment is required when you submit your insertion order. If the artwork is not submitted according to the required specifications or by the deadline, your advertisement position is forfeited, and the payment is non-refundable.

5. Vendor Selection and Payments

Freedom to Choose Vendors: For additional consulting services, you are not required to use vendors affiliated with Touch Point Consulting, although you may opt to. The agreement encourages you to choose vendors that you feel comfortable working with. Direct Payment to Vendors: If you use a third-party vendor for services such as printing, website design, etc., you must handle payments directly with the vendor. Touch Point Consulting is not involved in vendor payments.

2. Art and Content Requirements

Content Responsibility: You, as the sponsor, are fully responsible for the content of the advertisement, including any licensed art, photos, trade- marks, logos, and copy. You also take on the liability for ensuring the content is accurate and legally permissible.

6. Communication and Legal Matters

Email Communication: You authorize Touch Point Consulting to communicate with you, your staff, and your vendors through email, in- cluding approvals, updates, and project-related information. Responsibility for Email Approvals: If you request that Touch Point Consulting use email accounts you own, you agree to take full respon- sibility for any communications, including any approvals or lack thereof, that go through those email accounts. Contract Cancellation: Sponsorships in publications cannot be cancelled nor refunded once submitted. For consultting work contracts, if you wish to cancel this agreement, you must provide written notice at least 30 days before the contract end date. Both parties must agree to the cancellation. Dispute Resolution: Any disputes related to this agreement must be resolved in the Court of Common Pleas of Bucks County, Pennsylvania, or the U.S. District Court for the Eastern District of Pennsylvania and Monmouth County, New Jersey. You will be responsible for any legal or collection fees if the case goes to court.

File Specifications: Your submitted PDF must be:

- At the exact ad size300 dpi resolution

- Flattened with all fonts embedded.

- If the file doesn’t meet these specifications, the Publisher can reject it and request a new file within 48 hours of the due date.

Publisher’s Limitation of Liability: The Publisher is not responsible for any errors in the content (such as typos, incorrect information, or format- ting issues). You also acknowledge that the Publisher will not be involved in any third-party legal actions relating to your advertisement's content.

3. Consulting and Project Development Agreement

Consulting Services: If applicable, As a Member of TPC, you receive hourly consultation and fee-for-service production at a discounted rate. These services are based on time, not project deliverables. Volunteer Work: Some or all work may be performed by volunteers or contractors for the organization, and you agree not to hold the organization or its volunteers, staff, or contractors liable for any work provided (in- cluding materials, mentorship, advice, etc.).Intellectual Property: You con- firm that you have obtained the rights to any photos, stock images, logos, or content you provide for use in projects. You take full responsibility for the licensing of any third-party content.Licensing Maintenance: You are also responsible for ensuring that all licensing agreements (e.g., for stock images, domain names, logos) are maintained and updated as required.

7. Tax and Accounting Information

No Tax Documentation: AD&CC, Inc. will not issue nor are they to be issued any tax forms (such as 1099s or W-2s) to you or any contractors /volunteers involved in providing services for your projects. This is in accordance with IRS regulations, as AD&CC, Inc. is a nonprofit organi- zation.

8. General Terms

No Refunds for Non-Submission of Artwork: If you fail to submit the required artwork or if it doesn’t meet the publisher’s specifications by the deadline, you forfeit your position in the publication and will not be refunded. Non-Cancelable Insertion Orders: Once the insertion order is submitted and artwork files are provided, you cannot cancel the order after the due date.This contract aims to outline your obligations and responsibilities as a sponsor/member, as well as Touch Point Consulting’s role and limitations. It’s essential that you understand each of these terms, especially around liability, payment, and content responsibility.

4. Indemnity and LiabilityHolding Harmless
