BUSD Immigration Policy There has been a lot of news lately detailing undocumented criminal residents being arrested and deported by Immigration and Customs Enforcement (ICE) agents following President Donald Trump’s Executive Order, issued January 20, 2025. Those news stories have raised questions from our staff and families about what our policy is regarding ICE agents coming to our school sites. Barstow Unified School District (BUSD) Board Policy 5145.13, Response to Immigration Enforcement, provides guidance for district and school administrators and school site staff who may encounter ICE agents. Below are some of the steps District and school staff follow in the event ICE agents visit a campus or District office. ● Existing immigration law, specifically the 1982 U.S. Supreme Court decision in Plyler v. Doe held that undocumented students must be provided with equal access to public education, regardless of immigration status. ● Also, the Fourth Amendment protects against unlawful search and seizure, thereby requiring a judicial warrant for an arrest to take place. In some instances, an ICE agent may present an “administrative warrant,” which is not legally equivalent to a judicial warrant and does NOT require compliance. Only a warrant signed by a judge is legally binding. ● A student’s immigration status is covered under FERPA (Family Educational Rights and Privacy Act). Barstow Unified School District does not request or require parents/guardians to provide immigration status when enrolling their child(ren). ● Contact the District Office should ICE agents arrive at your school site. We are here to assist you and can arrange for legal counsel to respond to your school site, if necessary. ● Do NOT obstruct immigration officers, even if you feel they are overstepping their authority. Document their actions by taking pictures or videos, but do NOT obstruct the immigration officers. ● If a student’s parent/guardian is detained or deported, the student is to be released to emergency contacts or an individual with a caregiver's affidavit. Notify the student, emergency contacts and individuals with a caregiver’s affidavit that the student may continue to attend school for as long as they meet residency requirements for our District.

The window for the 2025-2026 Annual Update of Student Information is open. Please sign into your Infinite Campus Parent Portal account and complete the Annual Update. Completion of the Annual Update is required for your student to pick up their schedule for the upcoming school year. If you do not have an Infinite Campus Parent Portal account, please visit www.busdk12.com, click on the Infinite Campus widget, then click on the “Create New Account or Reset Password” button. If you are using your phone, go to www.busdk12.com, click on the three lines in the upper left corner, scroll down to Quicklinks, tap the “+”, then select Infinite Campus from the dropdown menu and select “Create New Account or Reset Password.” Thank you for your attention to this matter and for your involvement in and support of your child’s education!
