L

ast year, River Drive Construction, along with a partner, bought

a 1.4-acre property with a 10,000 s/f industrial building in Montvale, NJ, that was contaminated with pesticides from its former use as an apple orchard. Previously, no one hadwanted to buy it because of the length of time required under the NJ Department of Environmental Protection (DEP) for the clean- up process. But as the result of a new privatized environmental cleanup program, the Licensed Site Remediation Professional (LSRP) Program, River Drive was able to remove 700 tons of contaminated soil and resell the property within the space of 90 days. The result: a vacant, under- utilized property was returned to productive use (it was pur- chased by the business next door), the municipality reaped increased tax revenues as a result of the improvements, the

business that purchased the property was able to add to its employment rolls and environ- mental contaminants with pos- sible harmful effects to public health and to the environment were remediated. Moreover, all of this was ac- complished in months rather than years and at less expense than under the old system. (Full disclosure: yet another benefit of the program is that it allows entrepreneurially minded companies such as River Drive Construction and our partner, First Evergreen

Properties, to make a profit.) Although the property in Montvale was small, with relatively minor levels of con- tamination, its cleanup is indicative of what is happen- ing all over New Jersey as the innovative LSRP program, which has been phased in over the past three years, comes fully online. The program, which was established under the Site Remediation Reform Act of 2009, took full effect as of May 7. Under the LSRP program, continued on page A
