munity plans: review under the California Environ- mental Quality Act. This bill reenacts, as an urgency measure, provisions of law that prohibit a court from invalidating a development approval that was granted based on a community plan that meets specified cri- teria, if the development was approved or had a com- plete application prior to the community plan being invalidated. An act to add Article 8.2 (commencing with Sec- tion 65458) to Chapter 3 of Division 1 of Title 7 of the Government Code, relating to land use, and declar- ing the urgency thereof, to take effect immediately. SB 625, Wahab. Housing developments: disasters: reconstruction of destroyed or damaged structures. This bill (1) creates a streamlined ministerial approv- al process for rebuilding residential structures dam- aged in a disaster; (2) establishes timelines for home- owners associations (HOAs) to review development proposals; (3) limits the scope of covenants and oth- er instruments that would prohibit a property owner from rebuilding a residential structure destroyed in a declared disaster; and, (4) prohibits local agencies from preventing property owners from living in a mobile home on their property for up to three years following a disaster. An act to add Sections 4752 and 4766 to the Civil Code, and to add Chapter 4.2.2 (commencing with Section 65914.200) to Division 1 of Title 7 of the Gov- ernment Code, relating to housing. SB 634, Pérez. Local government: homelessness. This bill prohibits a local jurisdiction from adopting a local ordinance, or enforcing an existing ordinance, that prohibits a person or organization from provid- ing support services to a person who is homeless or assisting with acts related to basic survival. An act to add Section 53069.44 to the Government Code, relating to local government. SB 655, Stern. Dwelling units: indoor tempera- ture. This bill declares it is the established policy of the state that all dwelling units be able to attain and maintain a safe maximum indoor temperature, as specified, and provides that this bill does not expand any obligation of the state to provide a safe maximum indoor temperature or require the expenditure of ad- ditional resources to develop infrastructure beyond the obligations that existing under existing program requirements. An act to add Section 17914 to the Health and Safe- ty Code, relating to housing. SB 686, Reyes. Housing programs: financing. This bill authorizes the Department of Housing and Com- munity Development (HCD) to approve the payoff of an HCD loan in whole or part, prior to the end of its term, and the extraction of equity from a develop- ment for purposes approved by HCD. An act to amend Section 50406.4 of the Health and Safety Code, relating to housing. SB 748, Richardson. Encampment Resolution Funding program: safe parking sites: reporting. This bill allows the Encampment Resolution Funding (ERF) program to apply to safe parking sites and cre- ates additional reporting requirements for the ERF program by requiring local jurisdictions that include
safe parking sites in their application to describe specified details. An act to amend Sections 50252.1 and 50254 of the Health and Safety Code, relating to housing. SB 770, Allen. Common interest developments: EV charging stations. Eliminates the requirement that a homeowners association be named on an electric vehicle charging station’s insurance policy. Repeals the provision of existing law requiring a certificate of insurance for an electronic vehicle charging station built within a common interest development to name the homeowners association as an additional insured under the owner’s insurance policy An act to amend Section 4745 of the Civil Code, re- lating to common interest developments. SB 774, Ashby. Department of Real Estate and the Bureau of Real Estate Appraisers: Bureau of Automo- tive Repair. This bill makes various changes to the Real Estate Law and Real Estate Appraisers’ Licens- ing and Certification Law (Appraisers’ Law) stem- ming from the recent sunset review oversight of DRE and BREA and is the sunset bill for the Department of Real Estate (DRE or Department) and Bureau of Real Estate Appraisers (BREA or Bureau). Civil Actions: writs: housing de- velopment projects. Provides for the expedited judi- cial review of writs of mandate filed as a result of the denial of a permit or other entitlement for housing development projects or residential units at the trial and appellate level. An act to add Sections 46 and 1094.9 to the Code of Civil Procedure, relating to civil actions. SB 838, Durazo. Housing Accountability Act: hous- ing development projects. This bill revises the defini- tion of housing development project in the Housing Accountability Act (HAA) to exclude projects that include any hotel or motel space in the commercial portion of a project.
