DVAUCTION: Buyers may now view and bid on animals live via the internet at dvauction.com. If you plan to purchase via the internet, you will need to register with DVAuction for a buyer number prior to the sale. DVAuction Terms and Conditions can be found at dvauction/terms.com. Please familiarize yourself with them as they are in addition to these sale terms and conditions. IN-PERSON BUYER REGISTRATION: Previous buyers and new buyers can check-in/register for bid cards at the office on Friday evening before the sale and sale day. Please DO NOT register for a buyer number at DVAuction if you plan to attend in person. BIDDING: Each animal will be sold to the highest bidder—if you have the highest bid, you are obligated to complete the transaction. Bids are not retractable. Note: When bidding on heifers, multiply the bid by the # of head in the lot. DISPUTES: The auctioneer will settle any and all disputes as to bids; his decision on such matters shall be final. ANNOUNCEMENTS: All announcements from the auction box take precedence over the printed material in this catalog. DEFECTS: Known defects will be called to public attention at the time the animal enters the ring. BABY CALVES: Some heifers may calve while they are here. In order to protect the newborn babies, WE WILL NOT BRING SOME OF THEM TO THE RING. Our consignors are asked to assume reasonable responsibility for these calves while here, a limited responsibility after they leave, and any calf born after the time of sale is the full responsibility of the buyer. PURCHASER’S RISK: Each animal becomes the risk of the Purchaser at the time of sale. HEALTH: Health Papers will be furnished on each animal. Animals 18 months of age or older are Brucellosis tested within 30 days of the sale unless originating from a Certified Free Herd, Area or State. All bulls are fertility tested and test negative for Trichomoniasis. All females have been palpated and determined “potential, satisfactory breeders.” Please check with your AHC to determine what health papers will be required if travelling outside Texas with your purchases. Any extraordinary health certificates, tests, or documentation required for shipment shall be at buyer's expense. GUARANTEE: The cattle in this sale are guaranteed by the individual consignors. The Southeast Texas Independent Cattlemen’s Association acts as the selling agent only. Any breeding defect on an animal should be registered with the Seller immediately, but within six (6) months of sale. TERMS: Purchases made at the sale facility can be settled via cash, check (with valid driver’s license) or credit card. Internet purchases through DVAuction must be settled via wire or credit card. All credit card purchases will be assessed a convenience fee (% TBA @ Sale). “SETTLING UP”: When you have made your purchases, please settle up with our Office Staff before you leave the sale facility. Internet buyers will be sent an invoice sale day and contacted for payment information. LOAD-OUT & TRANSPORTATION: Payment/payment arrangements must be made with the office or load-out cannot occur. Buyers are solely responsible for transportation arrangements and if they are not hauling the animals themselves, they must let the office know the name and phone number of the hauler(s). Animals cannot be loaded out until after the sale concludes. It is our preference that all animals be loaded out Saturday. We understand this may not be possible for internet buyers; therefore, we have extended load-out to Sunday between the hours of 8 a.m. and 2 p.m.. It is imperative the sale secretaries / office be notified if animals will be hauled on Sunday. If independent gooseneck haulers are available they will register with the office on or before sale day. LIABILITY: Neither the Southeast Texas Independent Cattlemen’s Association, its members, the sale manager, nor any other person connected with the management of this sale assumes any liability, legal or otherwise. RIGHTS AND OBLIGATIONS: The above terms and conditions of sale shall constitute a contract between the buyer and seller of each animal and shall be equally binding on both.
