TGRA Jurisdiction
§ This is the power the TGRA has to adjudicate, issue orders, and judgments pertaining to a tribe’s gaming activities. § It provides the territory and functions within which the TGRA may properly exercise its power. § It grants the TGRA authority and control of individuals and subject matter. § It provides the Agency the authority to issue orders and the types of judgments, orders, and sanctions it may render. § A TGRA possesses jurisdiction over matters only to the extent granted by its Gaming Ordinance and established Regulations.
TGRA Personal Jurisdiction
§ A TGRA should have jurisdiction under its Gaming Ordinance over any person who: § Applies for and/or is granted a license or registration. § Applies for employment in the gaming facilities or in gaming related activities. § Enters into a Contract, engagement, or agreement related to gaming activities. § Anyone who participates in any gaming related activity authorized by your gaming Ordinance, or enters the premises of any gaming facilities licensed by the TGRA. § This provides jurisdiction over all licensed employees of the Gaming Enterprise. § Jurisdiction over contracted and/or licensed vendors and their licensed employees who work with or at the gaming facilities. § The patrons and public who enter the gaming facility consent to the civil jurisdiction of the tribe and therefore the TGRA.
