TGRA Jurisdictional Powers

§ The TGRA should have the power under the Gaming Ordinance to condition, suspend, deny, or revoke a license or registration they issue. § This would include vendor related licenses and registrations, and the ability to remove vendors from the premises and prevent the gaming enterprise for doing business with an entity. § Temporarily or permanently exclude, bar, or deny admission to any individual from or to the gaming facilities. § The power to impose civil fines against licensees for violations of law. § The power to subpoena individuals and information, to issue orders, of admonishment, censure, or reprimand; orders compelling subjects to take a particular action or to cease and desist from taking an action; and judgments, regarding licensing determinations and civil fines.

Purpose of Administrative Hearings

§ Is to enforce the gaming ordinance, and all rules and regulations pertaining to gaming activities. § To stop repeated violations of law. § To stop unfair or unethical practices. § To deter future violations. § To enforce compliance and maintain on-going compliance of gaming personnel. § To protect assets of the tribe and gaming enterprise. § To prevent and deter fraudulent activity. § Enforcement actions send a message that non-compliance will not be tolerated.
