In May, the Justice Department announced the creation of a Civil Rights Fraud Initiative that will pursue what it terms as divisive DEI policies and will prosecute violators under the Civil Rights Act. This has caused a wholesale scramble for many organizations, some of whom started or expanded their DEI efforts in
response to the 2020 high-profile murder by a White police officer of George Floyd, a Black man. These employers are having to pivot and reconfigure their approaches to diversity, equity, and inclusion within their HR departments to avoid being singled out as violators of a new and strict official interpretation of color- and gender-blindness.
