MINTON & DONELLO (THE ‘COMPANY’) TERMS & CONDITIONS OF SALE

Orders shall only be accepted by Minton & Donello in such quantities stated in Minton & Donello price list and sales literature.

New Accounts - For the first order trading with us orders received are to be paid cheque or cash on delivery. Subsequent orders may be on account subject to the relevant checks on bank and trade references. Application forms are available on request. Value Added Tax Vat is charged at the prevailing rate to all items marked ‘V’ in the catalogue. Payment - All credit account invoices are to be paid within 30 days following delivery. If payments are not received by the due date, Minton & Donello will charge the buyer interest 4% above base rate, calculated daily, on outstanding amounts until paid in full. Any bank charges incurred, such as unpaid cheques, will be passed to the buyer. Minton & Donello reserves the right to remove the credit facility if payments are frequently late or unpaid. Accounts passed to the debt collectors will automatically be returned to C.O.D. and excess charges incurred by so doing passed to the customer. All goods will remain the property of Minton & Donello until paid for in full, but the risk will pass to the buyer on delivery. Minton & Donello reserve the right to remove from the buyer’s premises all goods which have not been paid for by the due date, and the buyer is deemed to consent to Minton & Donello entering its premises for that purpose until payment is made in full. Prices - Prices sometimes change at short notice, and Minton & Donello reserve the right to pass onto the buyer any price increase imposed by its supplier between the date of an order for and the date of delivery of goods. Claims - On occasion that there may be a discrepancy or shortage of the order, or if the goods are damaged, the buyer must advise Minton & Donello within two working days of delivery. Returns - No returns will be accepted unless prior arrangements have been made. Minton & Donello cannot give credit for goods that are personalised and/or already price marked.

Sell-by Date - The buyer must ensure correct stock rotation as we are unable to give refunds for stock that remains unsold after its ‘best before’ date.

Deliveries - Minton & Donello aims to deliver when promised. However, late, or un- booked in deliveries cannot be accepted as a reason for refusing goods unless the buyer lets Minton & Donello know in writing before the goods are despatched. Brochures - Any samples, drawings, descriptive matter, or advertising materials produced by Minton & Donello and any descriptions or illustrations contained in Minton & Donello literature or on its website are produced for the sole purpose of giving an approximate idea of the Goods described in them.
