The Department of Ecology may be legally required to deem the appropriate level of the GP Mill clean up to be its continued zoning level of industrial use. The current process is summarized in the graphic ending with a land covenant as shown in the Rayonier Port Angeles cleanup . 25 Here is a deeper dive: Under Washington State law an industrial level cleanup. This would likely be determined by the Comprehensive Plan’s zoning . This would preclude 26 future uses of any portion of the property for: • Hospitals • Schools • Hotels
• Residential • Commercial
• Children on the property • Public Recreational Use • Public Access in general Why? The mill property would still be considered industrial.
What constitutes industrial property? The criteria from the WAC is included as a footnote. The mill meets the criteria for industrial property meaning the cleanup level is established as industrial. This triggers a most troubling requirement. For all practical purposes, the property must remain padlocked and limited to most future uses the community envisions. This is through use of a land covenant, required by the State of Washington. 27

In applying the criteria in (a) of this subsection, the department expects the following results: 26 (i) The department expects that properties zoned for heavy industrial or high intensity industrial use and located within a city or county that has completed a comprehensive plan and adopted implementing zoning regulations under the Growth Management Act (chapter 36.70A RCW) will meet the definition of industrial property.”(emphasis added) “(ii) The cleanup action provides for appropriate institutional controls implemented in accordance with WAC 27 173-340-440 to limit potential exposure to residual hazardous substances.
