A summons is also issued with the complaint, which serves as a notice to the defendant that a lawsuit has been filed and when and how the defendant should respond to the complaint. Service of Process In order to gain jurisdiction over a defendant, the summons and complaint must be served by personal or substitute service. In addition, the summons and complaint must be mailed to the defendant or printed in a local paper. Court Date After the summons and complaint are served, the homeowner generally has 30 days to file an answer and appearance. After the 30 days are up, the court may set a case management date, or the mortgage company may bring forward a motion for default and judgment.

Judgment If the homeowner fails to appear, or the court finds the mortgage company’s allegations true after a hearing, the court enters a judgment order in favor of the mortgage company. In Illinois, the homeowner has a least three months from the date of judgment to redeem the property by paying the full amount of the mortgage company’s claim. Sale After the redemption period expires, the mortgage company may place the property up for judicial sale or auction. After the sale, the mortgage company must go back to court in order to confirm the sale, which will come from a judge order.
