• The DWI offense in question must be your first.

GETTING YOUR DWI OFF YOUR RECORD

• Your blood alcohol concentration (when you committed the DWI offense) has to be lower than 0.15.

• You must have a clean criminal record (i.e. you have never been convicted of other crimes). Also, you shouldn’t have a history of being placed on deferred adjudication community supervision. This condition doesn’t apply to minor traffic offenses.

On Sept. 1, 2017, a law was put into action in Texas that may be of great value to you. It allows us to obtain an order of nondisclosure regarding DWI convictions. An order of nondisclosure causes the record of a DWI conviction to be sealed from public view and prevents disclosure of the record of conviction to the public. The order also allows a person to legally deny the existence of the DWI conviction and means that the DWI conviction will not show up on a background check, which can help your rental and job prospects. However, law enforcement will continue to maintain a record of the conviction, and it can be used against a person if that person gets in criminal trouble again in the future or gets another DWI. Also, if a person is applying for a job or a professional license with the state or federal government, the conviction will show up and could negatively affect that person.

• You must have successfully completed community supervision and served applicable jail time.

• You must have paid all due fines, court costs, and any restitution that was part of your sentence.

• The waiting period must pass before you petition the court. A petition for nondisclosure on DWI offenses has specific guidelines. Orders of nondisclosure are denied if there is evidence (from the state) that the underlying DWI case resulted in an accident involving other persons, including any passengers who were in the defendant’s car at the time. 1/2 cup

2 tbsp olive oil

1 onion, chopped

peanuts, chopped

8 oz baby bella mushrooms, sliced 4 cups broccoli, chopped to bite-size pieces

2 tbsp soy sauce

Toppings of choice for serving (sliced green onions, sliced cucumber, chopped peanuts, lime wedges, Sriracha, etc.)

4 cloves garlic, minced

5 cups jasmine rice, cooked and cooled

4. Finally, add the rice and cook, stirring constantly, for 3–4 minutes. 5. Remove skillet from the heat and stir in the peanuts and soy sauce. 6. Serve garnished with your toppings.
