Auction Protocol The ruling from the sale manager is final. Sale day announcements take precedence over previously printed materials.
All bulls have passed a breeding soundness exam within 60 days of the sale, and have been deemed in good health and structurally sound at the time of sale. All bulls are virgin, and older bulls have negative Trich-test results. All bulls are NAPA registered and DNA-test verified as 2-copy for the Piedmontese myostatin gene. Registration certificates will be ownership-transferred to the buyer. Payment Terms IN PERSON Terms are cash / check payable to Burwell Livestock Market. INTERNET BUYERS Terms are payment is due on Monday, April 28, 2025 by wire transfer to Burwell Livestock Market. Call Burwell at 308-346-4257 for wire instructions. Breeding Guarantee Producer warrants that bulls shall be conveyed with a six (6) month breeding guarantee, from the date of purchase. Should any bull fourteen (14) months of age or over fail to prove a breeder after being used on females known to be breeders, the matter shall be reported in writing to the seller within six (6) months following the date of purchase or six (6) months after the bull has reached fourteen (14) months of age. The seller will have the right and privilege of six (6) months to prove the bull a breeder. Buyer agrees to notify the Producer within seven (7) days of the injury of any bull(s) on which the Buyer wishes to make a warranty claim. In such event, Producer covenants and agrees to provide a replacement bull of equal quality or credit towards another bull, upon receipt of written verification from a licensed veterinarian confirming the bull is unsound due to reasons other than negligence or willful misconduct on the part of the Buyer. Producer has the right to request a second veterinary exam, at Producer’s sole cost and expense, and shall be entitled to any salvage proceeds. Such credit shall, in any case, be deemed full satisfaction and settlement. In addition, Producer’s liability to Buyer is expressly limited to any such credit of the full purchase price paid by Buyer pursuant to this Bill of Sale, and in no circumstances shall Producer be liable for consequential or incidental damages. Such warranties are expressly from Producer to Buyer desig - nated hereto and not to any third parties. Purchasers Risk Each animal becomes the risk of the buyer as soon as sold. Buyer will be responsible to reimburse Lone Creek Cattle Company for feed and care from date of sale until the bulls are picked up or delivered. Terms on Semen Interest Consigning Producer shall retain a fifty percent (50%) semen interest and the Buyer will receive a fifty percent (50%) semen interest and full possession in bulls sold. Buyer agrees to make bulls reasonably available for semen collection by If the Producer has enrolled, at least 48 hours prior to the sale, a bull into the optional Semen Certificate Program the Producer agrees to provide an unlimited amount of signed semen certificates, free of charge, to the Buyer for as long as he owns the bull for the purpose of registering his own offspring from the bull. For bulls not enrolled prior to purchase, the Buyer may enroll the bull at his sole cost and agrees to provide the Producer an unlimited amount of signed semen certificates, free of charge, to the Buyer for as long as he owns the bull for the purpose of registering his own offspring from the bull. Any bulls enrolled by the Producer in the Semen Certificate Program will be announced prior to selling. Semen PRE-ORDER Designated Bulls For bulls that are designated as Semen-Pre-Order Bulls, proceeds from semen pre-orders will go directly to the bull BUYER after the semen has been professionally collected and frozen, with no part of these proceeds shared to the bull producer. Collection and freezing costs are the responsibility of the bull buyer. Payment will be made directly from the semen buyer to the bull buyer, after viable semen has been collected and frozen, but before it is shipped. Shipping cost is the responsibility of the semen buyer. The amount of semen pre-ordered and the dollar amount offered for semen on each bull will be announced before bidding starts on that bull. The buyer of any bull with semen pre-order contracts in place is expected to cooperate with the semen collection project. The buyer of the bull has full possession of the bull and can turn him out with cows whenever is needed. Semen collection will be worked around the bull buyer’s breeding season. the Producer, at Producer’s sole cost and expense. Semen Certificate Program (optional)
