HMRC issues RTI 201 overpayment letters in error

Over the last few days several members have contacted the CIPP policy team to tell us they have received a letter from HMRC telling them they have overpaid for the period July to October 2014. As we have not reached the end of that period yet these letters have been causing some confusion for the recipients.

We contacted HMRC who confirmed these letters had been issued in error and should be ignored. The full explanation is available on HMRC’s website .

Aligning payroll to the correct tax period

HMRC have issued guidance reminding employers of the need to realign the payment date of a Full Payment Submission (FPS) with the tax month or week if it was reported it incorrectly or if the payday has changed.

The HMRC document says:

When you send a Full Payment Submission (FPS) to HMRC, you need to include the date you paid your employees.

You’ll have to realign the payment date of your FPS with the tax month or week if:

 you’ve changed the day you pay your employees  you sent an FPS where you used the date you ran payroll (instead of the date you paid your employees)

Penalties for late real-time PAYE returns to be phased in

HMRC have announced how automated in-year penalties for late real-time PAYE returns will be phased in.

The HMRC announcement says that:

Employers with fewer than 50 employees will face automated in-year penalties for late real- time PAYE returns from 6 March next year.

Those who employ 50 or more people will face penalties from 6 October 2014.

HM Revenue and Customs (HMRC) will send electronic messages to all employers shortly to let them know when the penalties will apply to them, based on the number of employees shown in the department’s records.

Ruth Owen, HMRC Director-General for Personal Tax, said:

”Real Time Information is working well. Our most recent figures show that over 95% of PAYE schemes making payments to individuals are successfully reporting in real time, and 70% say that it is easy to do. We know from our experience of rolling out of RTI that to ensure a smooth transition for our customers it’s best to introduce changes in stages. This will allow us
