10.3 Dismissal

Gross misconduct and serious negligence are grounds for dismissal. Summary dismissal may be affected by AfriLabs without notice at any time for offences listed in the (examples of unacceptable behaviours) above.

Administration

If an employee is dismissed for serious negligence or gross misconduct, they will only be paid a prorated salary for the period worked up to the dismissal date. A separation checklist will be completed by Administration and Finance prior to the disbursement of final payments to departing employees. People Management will be responsible for notifying the employee of the details of the final pay. The supervisor will coordinate with People Management and Administration for the return of all AfriLabs property, as per the termination checklist.

Right of Appeal

An employee may appeal their discharge in writing to an independent external arbitrator or relevant external body within two weeks of the discharge date. The cost of the appeal will be borne by the employee. Following the appeal, the final decision will be made by Management, based on the recommendations of the Arbitrary Committee. The decision of Management will be final and binding on all parties.
