CARRY WITH CAUTION NAVIGATING GEORGIA’S CARRYING CONCEALED WEAPON LAWS

LAUGH IT OFF

Back in 2010, Georgia changed its laws concerning the carrying of weapons throughout the state, along with modifications to concealed carry regulations. Individuals are permitted to carry a weapon if they meet specific criteria:

• Possess a valid “weapons carry” permit • Carry a handgun, whether concealed or not

• Hold a license to carry a weapon or handgun from another state, provided that state recognizes Georgia’s weapon carry license • Possess a valid fishing or hunting license While owning and having a weapon in one’s home or place of business is legal, carrying it outside these locations necessitates a permit. Carrying a concealed weapon without a permit is illegal in Georgia. In Atlanta, carrying a weapon is prohibited under two circumstances: when entering a government building (even with a permit) and when the person lacks a permit. Georgia prosecutors must prove, beyond a reasonable doubt, that a defendant violated the carrying concealed weapons law. Specific elements guide prosecutors in establishing guilt: • The defendant possessed the weapon outside their home or business. • The defendant lacked a permit at the time of arrest. Penalties for carrying a concealed weapon vary based on the number of convictions. A first-time conviction will result in misdemeanor punishment, including approximately 12 months in jail and a $1,000 fine. A second conviction within five years is considered a felony, carrying a penalty of two to five years in state prison.
