HARMONSON HEADLINES YOUR GUIDE TO PERSONAL INJURY IN THE BORDERLAND JULY 2024
Silence Is Golden!
WHY THE BEST LAWYERS MIGHT ACTUALLY TALK THE LEAST
Plenty of people seem to believe that a good lawyer is one who can talk their way through anything, but I can assure you that there’s one skill that surpasses debating or negotiation: listening. World Listening Day is July 18, a day that reminds me to do a bit less chatting and a lot more listening! Honestly, active listening isn’t just a part of my job — it’s at the core of it. And while it sounds simple, mastering the art of truly listening is something I continually work on. One of the first rules I learned in law school, which I sometimes joke about, is to stop talking so much. Lawyers are notorious for loving to talk, but the essence of our work requires us to listen — really listen — to our clients. When clients come in, they carry their stories laden with details, emotions, and facts. Early on, I noticed my tendency to steer conversations, anticipating information I assumed I needed, which is helpful but risky. There’s a danger in that — missing out on crucial details that could be pivotal in a case. It takes a certain amount of restraint to just zip it and listen! In my practice, I’ve found that the deepest connections are formed when clients feel genuinely heard. That means our conversations are more than just about gathering facts; it’s about understanding their experiences and emotions. Whether it’s consulting with a client or conducting a deposition, the skill of listening often proves more valuable than the ability to speak eloquently. I always start with an outline as to what I plan on saying, but it’s attentive listening that fills in the crucial gaps that no outline can predict. Hence the bright blue, all-caps note you’ll find above my outlines: “LISTEN!” For attorneys, listening is a two-way street. It’s not just about us hearing our clients; they also need to listen to the advice and guidance we provide. There are times when clients are so overwhelmed by their situations that they find it difficult to absorb the legal pathways laid out for them. This is where patient, empathetic listening plays a crucial role.
Outside the courtroom and my office, I apply these listening skills in my personal life, especially with my family. My son, Winn, who is 5 and spirited ( aka stubborn ), often tests my patience. Just recently, trying to get him ready for his older brother Clayton’s concert was a challenge. He wouldn’t leave the shower or get dressed, and in those hectic moments, the value of patient listening became more apparent than ever. I can’t say that I always practice what I preach in the exact moment, but looking back, I could have handled the situation better by trying to figure out what exactly was bothering him. Being a good listener isn’t an innate trait; it’s developed through persistent practice and conscious effort. If I could offer a few tips to my younger self or anyone eager to improve their listening skills, they would be straightforward: Close your mouth and open your ears. It sounds simplistic, but the act of physically quieting your own voice to prioritize another’s can be endlessly impactful. Slow down, stay quiet, and give others the space to express themselves fully. This World Listening Day, I can’t help but think of how vital active listening has been in my career and personal life. It’s a skill that has allowed me to connect more deeply with those around me and has undoubtedly made me a better attorney, father, and listener.

As we wade through the hottest part of the year here in El Paso, the soaring temperatures bring not just a slight discomfort but genuine risk, especially for those working outdoors. Understanding your legal rights concerning heat-related work injuries is vital, and we’re here to help guide you through your options. Every year, as the mercury climbs, we see an uptick in heat-related illnesses among outdoor workers. Sadly, this is often exacerbated by people enforcing work conditions who do not take the extreme heat seriously enough. If you’re
working outside during these scorching summer months, it’s vital to recognize the signs of heat exhaustion and heat stroke and know the law may be on your side if your employer is negligent. WHY HEAT-RELATED INJURIES ARE A LEGAL MATTER. In Texas, as in many states, employers are obligated to provide a safe working environment. This includes reasonable protections against the elements, heat
included. Despite this, every summer, we see cases where employees suffer due to inadequate precautions against the heat. Common symptoms of heat-related injuries include dizziness, fainting, dehydration, headache, slurred speech, nausea, and in severe cases, even death. WHAT CAN YOU DO? 1. Hydration is key: Always ensure you’re drinking
plenty of water. It’s not just good sense; it’s your first line of defense against heat-related health issues.

2. Work schedules: Advocate for earlier start times. Working in the cooler morning hours can significantly reduce the risk of heat illness. 3. Take complaints seriously: If you’re an employer, take your team’s complaints about the heat seriously. Prevention of heat-related illnesses should be a priority, not an afterthought. 4. Know your rights: Familiarize yourself with workplace safety standards and your rights as an employee. If you or someone you know has suffered from a heat-related injury at work, legal recourse might be necessary. DER THE SUN OR WORK-RELATED HEAT INJURIES
Amusement parks and pools are quintessential summer destinations, providing roller coaster thrills and a refreshing escape from the heat. However, these fun-filled venues can also pose substantial risks. I’ve seen excitement turn to emergency in moments, emphasizing the need for awareness and proper response to these types of accidents. UNDERSTAND THE RISKS AT PLAY Attractions like roller coasters and water slides are inherently risky. For example, a few years ago, an incident occurred at Western Playland when a ride that my kids and I were riding unexpectedly stopped mid-roller coaster, forcing us to disembark via a ladder. An event like this one reminds us that not everything is as safe as it may seem. That’s why stringent safety regulations must be followed by the park’s staff or property owners. Surprisingly, the average pool can also be dangerous. Did you know that drowning is the leading cause of unintentional injury- related death for children ages 1–4? I recently managed a case where a young individual tragically drowned in an apartment complex pool that did not have a permit to operate. These facilities are governed by strict commercial safety standards that, when neglected, can lead to catastrophic outcomes. THE ROLE OF VIGILANCE For parents, vigilance is the first line of defense against potential dangers. A visit to the pool or amusement park often comes with a false sense of security. Just last summer, a drowning at a city park served as a sobering reminder of the lurking risks. Following such incidents, there is often a swift move to attribute blame, with defendants frequently pointing fingers at parents. However, accountability is multifaceted, and understanding the legal framework is essential. LEGAL SUPPORT AND ADVOCACY If you or someone you know has suffered an injury or accident at an amusement park or other public space this summer, seeking expert legal advice is crucial. These organizations and their staff have a legal duty to ensure their premises are safe for all visitors. When this duty is breached, they need to be held accountable. Awareness and preparedness are also vital to ensuring that fun days out remain safe. When you understand the risks, maintain vigilance, and know your legal rights, you can help safeguard your family’s well-being during these exciting but potentially hazardous summer outings.
