The Company may not, as a condition of employment, continued employment, promotion, compensation, or the receipt of benefits, require or coerce you to enter into an agreement that contains a nondisclosure provision, a nondisparagement provision, or any other provision that has the purpose or effect of preventing you from disclosing or discussing any conduct: That occurred between employees or between the Company and an employee in the workplace or at a work-related event that is off the employment premises and coordinated by or through the Company; or That occurred between the Company and an employee off the employment premises. That constitutes unlawful discrimination or harassment (including sexual assault); and If you have claimed to be a victim of unlawful discrimination or harassment (including sexual assault), the Company may only enter into a settlement, separation, or severance agreement with you that includes one or more of the following provisions, if you request to enter into such an agreement: A nondisclosure provision, a nondisparagement provision, or any other provision that has the purpose or effect of preventing you from disclosing or discussing any conduct as outlined in the previous paragraph. A provision that prevents the disclosure of factual information relating to a claim of discrimination or conduct that constitutes sexual assault; or A no-rehire provision that prohibits you from seeking re-employment with the employer as a term or condition of the agreement. If the Company makes a good faith determination that you have engaged in unlawful discrimination or harassment, the Company may enter into a settlement, separation, or severance agreement that includes one or more of the provisions described above. Any settlement, separation, or severance agreement reached by you and Company may be revoked within seven days of its execution, and the agreement will not become effective until after the revocation period has expired.
