l If an investigation requires witness statements, it may be useful or desirable to: u Secure affidavits u Conduct a fact-finding hearing, where witnesses are placed under oath

l An evidentiary hearing is not an adjudication l It is an investigatory tool – in that may be used to determine whether additional steps are warranted given the availability of competent evidence l In criminal law, examples of evidentiary hearings include: u Preliminary Hearing u Grand Jury
