FORWARD 2021 Maryland Judiciary Statistical Abstract Each year, the Maryland Judiciary presents its annual fiscal year statistical abstract. The data and statistics collected for the abstract include all four levels of court, including the Court of Appeals of Maryland, Court of Special Appeals of Maryland, the District Court of Maryland, and the state’s circuit courts. The 2021 Statistical Abstract comprises trial and appellate court caseload data, providing information and insight regarding the volume, type, and disposition of cases handled by Maryland courts. The statistical abstract helps to ensure transparency by providing data and public information in a consistent annual format. This compilation of data demonstrates the Judiciary’s commitment to innovation and service, as well as ensuring that cases are processed in a fair, efficient, and effective manner. Maryland’s judicial branch maintains its steadfast commitment to the rule of law, adjudicating cases, improving access to justice for all, and providing excellent customer service to court users and visitors. PASSING THE GAVEL

CHIEF JUDGE MARY ELLEN BARBERA, 2013 – 2021 In 2021, I concluded my time as chief judge of the Court of Appeals of Maryland. I thank the many people who worked with me to help move justice forward in Maryland. We accomplished so much together, and we persevered through the COVID-19 pandemic with the Judiciary continuing to provide access to justice throughout. The future is bright for the Judiciary and it is certain that access to justice will continue to flourish and grow. I have full confidence that the positive changes we made will inspire all future chief judges to continue to move the justice forward in Maryland.

CHIEF JUDGE JOSEPH M. GETTY, 2021 – 2022 In September 2021, I was humbled and honored to be appointed by Governor Larry Hogan as chief judge for the Court of Appeals of Maryland. Many of the Judiciary’s recent accomplishments are a direct reflection of the exceptional leadership portrayed by my predecessor, then Chief Judge Mary Ellen Barbera. When the gavel was passed to me, I made the commitment to continue the push for excellence in service to justice for Maryland through all levels of the courts. Specifically, I appointed the Joint Subcommittee on Post- COVID Judicial Operations to analyze the current use of remote technology and other court innovations for possible continuation in judicial operations to provide the highest level of service within the Judiciary.

CHIEF JUDGE MATTHEW J. FADER, 2022 – The success of the Judiciary’s mission depends on the united efforts of everyone reading this, because we all play a crucial part in the Judiciary’s success. That has always been so, but it has never been more evident than over the past 28 months. Recent times have been challenging, to say the least. But, under the leadership of Chief Judges Barbera and Getty, we have collectively responded with countless innovations and adaptations that allowed the Judiciary to continue core operations during the pandemic while, at the same time, furthering our commitment to equal justice. As a result of those efforts, we are stronger and better positioned to meet the challenges of today and tomorrow.

The Court of Appeals of Maryland (Court) was created by the Constitution of 1776 and is the highest court in Maryland. Cases heard by the seven judges of the Court are, for the most part, selected through a discretionary review process. Petitions for certiorari come to the Court either before or after a case has been decided by the Court of Special Appeals of Maryland. For most cases, the Court grants those petitions for certiorari it deems to be desirable and in the public interest. The Court also adopts rules of judicial administration, practice, and procedure; admits persons to the practice of law; answers certified questions of law; and conducts disciplinary proceedings involving members of the bench and bar. The Court sets cases on its regular docket from September 1 to August 31, referred to as the “Term.” Petition docket cases are set from March 1 to February 28. The Court typically hears cases from September through June. There are two periods of time that are used to measure data collected in the Maryland courts, “Term” and “Fiscal Year”. The trial courts (District Court and the circuit courts) report data using the measurement of fiscal year (July 1 through June 30). To provide consistency in reporting, Court statistics are shown by fiscal year and by term. The case processing goals adopted by the Court provide that all cases argued or filed during a term are to be decided before the term’s completion. This goal is similar to that of the U.S. Supreme Court and is part of the Judiciary’s commitment to ensure timely adjudication for all those with business before the courts. The following tables provide a statistical depiction of the Court’s workload for Fiscal Year 2021 and for the 2020 Term (September 1, 2020 - August 31, 2021). COURT OF APPEALS OF MARYLAND

The Court of Special Appeals (Court) was created in 1966. Cases heard by the Court include any reviewable judgment, decree, or order of other action of a circuit court. The Court also considers applications for leave to appeal in such cases as post conviction, habeas corpus matters involving denial of or excessive bail, inmate grievances, appeals from criminal guilty pleas, and violations of probation. The Court includes 15 judges — one judge from each of the seven appellate judicial circuits and eight from the state at large. The judges are empowered to sit in panels of three. All judges may sit “en banc” (meaning "the full bench") to hear a case if the majority of the judges so order. CIRCUIT COURTS

In Maryland, each county and Baltimore City has a circuit court. Circuit courts are the trial courts of general jurisdiction and are the only courts empowered to hold jury trials. The 174 judges handle major civil cases, serious criminal matters, and all family matters, including juvenile matters. Circuit court judges also decide appeals from the District Court and certain administrative agencies. Judicial magistrates primarily hear family and juvenile matters and make recommendations based on their findings to the judge. In addition to judicial functions, these courts are responsible for recording the state’s land record transactions, as well as issuing a number of business licenses. Clerks of the court issue marriage licenses, and civil marriage ceremonies are frequently performed by judges and clerks. Circuit courts are grouped into eight geographical circuits, each with two or more counties, with the exception of the Eighth Circuit, which consists of Baltimore City. The following tables provide statistics on the workload in the circuit courts for the last three fiscal years.
