Administrative Adjustments (Staff Approval) Admin Adjustment can be approved only when all of the following criteria are met: ■ The functional classification remains unchanged ■ The alignment shift does not exceed 1,000 feet from the adopted centerline ■ The corridor serves the same endpoints* as the adopted alignment ■ The alignment change does not affect parkland ■ Written consent has been obtained from adjacent property owners. Administrative Adjustments are reviewed and approved by the Development Services Department, with guidance from the City Traffic Engineer and consultation with TPW. Where staff determines it is in the public interest, the adjustment may be referred to CPC for amendment review. *Note: Endpoints are defined as the terminal intersections or termini of an adopted corridor alignment as shown on the Master Roadway Network map. 1.10.3. Waiver Requests (Administrative or Public) A Waiver applies when a development proposes a deviation from the adopted dimensional standards of a roadway cross-section or ROW requirement. Waivers do not change the Master Roadway Network map; they apply only to implementation on a specific site.
1.10.4. Combination Requests Some proposals may require both an Amendment and a Waiver. Examples include: ■ A roadway realignment (-> Amendment) combined with dimensional deviations (-> Waiver) ■ A classification change (-> Amendment) combined with a ROW change (-> Waiver) Where a proposal requires both an Amendment and a Waiver, both shall be submitted concurrently and reviewed together by the CPC. No administrative waiver shall be granted for elements of a proposal that also requires CPC approval of an Amendment. If a request does not meet the criteria for an Administrative Waiver, a Public Waiver is required. For purposes of this section, required elements include travel lanes, medians, flex zones, and multimodal facilities (sidewalks, shared-use paths, and on-street bicycle facilities). Parkway and buffer zones are required elements, but reduction in widths and, if necessary, removals are subject to Administrative Waiver procedures.
The waiver procedures in this section govern MRN cross-section implementation. Sidewalk construction waivers based on constructability are governed by the City’s existing sidewalk waiver process, which is not superseded by this section. Two levels of waivers are available: A. Administrative Waiver (Staff Approval) An Administrative Waiver may be approved only when all of the following criteria are met: ■ All required elements of the adopted cross- section remain present ■ The total ROW variance does not exceed 16 feet from the adopted dimension ■ The need for the waiver is based on documented constructability or safety issues Administrative Waivers are reviewed by Development Services Department, with guidance from the City Traffic Engineer and consultation with TPW. Where staff determines it is in the public interest, the adjustment may be referred to CPC for review. B. Public Waiver (CPC Approval) A Public Waiver is required when one or more of the following occur: ■ The ROW variance exceeds 16 feet from the adopted dimension ■ A required element of the adopted cross- section is removed or cannot be provided ■ The proposal does not meet the requirements for an administrative waiver. Public Waivers require approval by the CPC.
