The Legal Preliminaries

If you have changed your name by deed poll, change of name deed or statutory declaration the documents will need to be shown.

If either of you is a foreign national you may need to give notice at a designated register office and a different waiting period may apply. Please contact us for further guidance. Documents you may need to produce When giving notice of marriage you will need to produce proof of your identity. Valid passports are ideal, but if you do not have a passport we will advise you on the alternative documents that can be accepted. You will also be asked to show proof of your current address, from a recent utility bill or bank statement, valid UK driving licence, or Council tax bill for example. If you have been married or through a civil partnership before, you will need to show the decree absolute or dissolution certificate bearing the court’s original stamp. If your former husband, wife or civil partner has died we will need to see a certified copy of their death certificate.

Before you can marry in a civil marriage in England and Wales or have a civil partnership you must give legal notice of your intent to do so. A notice of intention to marry is a legal document which is valid for one year and a notice must be given by each party to the marriage or civil partnership in person. The following information also applies if you are marrying by religious ceremony and for marriages in the Church of Wales or Church of England if either of you is a foreign national. Both of you must have lived in a registration district in England or Wales for at least seven days before giving notice at the register office. If you both live in the same district you will need to give a notice each and will be asked to attend together. If you live in different registration districts then each of you will need to give notice in your own area. Notices must be entered at least 28 clear days before the marriage or civil partnership can take place, but you can give notice up to a year in advance.
