THE KRAMER CHRONICLES YOU CAN’T GIVE UP ON YOURSELF WHEN THAT MOUNTAIN STARTS STARING YOU DOWN, 08.19 WWW.KRAMERLAWGROUP.ORG | 801.601.1229

T he very first day of this month, we celebrate National Mountain Climbing Day, a less popular holiday that can be significant depending on how you perceive it. Literally speaking, I’m a mountain climber. Every year, I climb Guardsman Pass on my bike, starting as soon as the snow melts enough for me to make the trip. But I have also gone on several hiking and backpacking trips up mountains here in Utah. During my frequent trips to Mt. Timpanogos, a peak close to my house, one climb stands out a little more than the rest, and not just because of its elevation. Several years ago, I was serving as a scout leader and took the 12–14-year-olds up Kings Peak, the highest mountain in Utah. Unfortunately, I didn’t physically or mentally prepare as much as I should have, and I packed way too much. I even brought along a 2-pound bag of licorice which I quickly realized was overkill. But that’s the temptation when you’re trying a new adventure — you think you need to bring everything when, in reality, it's much better to pack only essentials. During all of these climbs, whether on bike or foot, I’ve had moments where I considered turning around. But, in those defeating moments, I realized that if I quit, I’d regret it. So, I dug my heels in and pressed onward. The most important lesson I’ve learned from all this climbing is once you’re standing at the top of the mountain,

journeying up those mountains, I put my head to the ground and pushed forward. Just as I trained and prepared for epic mountain climbing trips, I sought out all the opportunities I could to better myself as an entrepreneur and an attorney. If I felt nervous about an upcoming trial, I tried to find opportunities to speak in public to calm my nerves. I associated myself with others who had paved their own path similar to mine. I asked them for advice to gain perspective and understanding. Just as you would consult fellow climbers

“THE MOST IMPORTANT LESSON I’VE LEARNED FROM ALL THIS CLIMBING IS ONCE YOU’RE STANDING AT THE TOP OF THE MOUNTAIN, HILL, OR PASS, YOU WILL NEVER REGRET HAVING PERSEVERED.”

for information regarding clothes, food, and trail reports, if you’re starting a new professional venture, turn to like- minded people for counsel. Lastly, try not to compare your own success with others. If you’re attempting a peak for the first time, you wouldn’t be upset if someone who climbs the mountain every day passed you on the trail. The same goes for pursuing a new professional dream. It doesn’t matter how much better or worse someone else is doing. As long as you’re moving, you’re progressing. It doesn’t matter how slow your pace.

hill, or pass, you will never regret having persevered. You never finish the challenge and think, “That was a waste of my time.” In my experience, regret only comes from not trying at all. This lesson helped me persevere when I decided to start my own law practice all those years ago. I read several statistics claiming that 80% of small businesses fail within the first 10 years. As a new business owner, I understood the odds were stacked against me. But, just as I did in the moments of exhaustion or fear when

In business and in life, you never know what the future holds, but, if you keep your mind open, exercise a little faith, and give yourself the shot you deserve, opportunities open themselves up for you. Try it, and you’ll see!

For most, the period between Memorial Day and Labor Day is the optimal time for those precious lazy summer days full of afternoons spent lounging around the pool and barbecuing delicious meals. One multifaceted side effect of this time of year — the months from June to August — is that the kids are out of school. While their presence at home means they can join in on the summer fun, it also means they are out on the road more often. The roadside-services provider AAA dubbed this period the “100 Deadliest Days” based on the tragic fact that the average number of deaths from crashes involving teen drivers was 17% higher per day compared to other days of the year. Furthermore, the AAA Foundation for Traffic Safety determined that nearly 3,500 people have been killed in crashes involving teen drivers during this time period over the last five years. Here at Kramer Law Group, we don’t report these sad statistics to scare you, but we do want you to take some precautions if you have teenage drivers at home. Everyone knows it’s illegal to operate a vehicle after drinking, but teenagers need constant reminders. According to Cars.com, 20% of 15–19-year-old drivers involved in deadly crashes had been drinking alcohol despite the fact they were too young to legally purchase it. In addition to those reminders, let your child know that if they do drink, they can call you. While their underage drinking may upset you, it’s better to withhold that anger to help them feel they can call for help rather than get behind the wheel. Second, practice what you preach. If you’re reinforcing the importance of your teen putting the cell phone away when driving, make sure you follow your own advice and keep that phone stowed when you drive. Research shows that texting while driving increases your teen’s risk of crashing by 23 times. Show them that a text or a call can wait by modeling that behavior for them first. Unfortunately, even with proper precautions, accidents can still happen, and if they do, we want you to know we are here to help. Give our office a call at (801) 997-9297. THE RIGHT PLACE AT THE WRONG TIME

There is no shortage of crazy cases that come through a court of law, but those revolving around personal injury can be especially surprising. Whether it’s a slip-and-fall accident or something a little more eccentric, there are a million ways to hurt yourself while simply going about your day. The problems arise when it’s determined to be another party’s fault. Let’s take a look at some notably strange cases where bizarre miscalculations led to injuries and ailments. Time spent in the restroom is inherently private. We don’t normally talk about it, but that’s not the case for a Pennsylvania woman who experienced a traumatic event during a routine trip to the lady’s room. In 2007, a schlocky horror plot came to life in a building along Philadelphia’s famous Market Street. The culprit was a faulty plumbing system. The woman was inside a restroom stall on the eighth floor, and, as she sat on one of the old toilets customary in the building, pressure building from inside the tank caused a massive explosion that sent her body hurling out of the stall. You don’t need to know the details of her injuries to understand the extent of her grievances. Some forms of suffering are better left to the imagination, especially if the aggressor was a literal stink bomb. She sued the building’s landlords for anxiety, pain, and medical expenses, but it’s hard to determine which party was truly at fault without more information. You can’t predict the weather, no matter what your weather app says, but some people tend to forget that. A few years ago, an Israeli weatherman was faced with a lawsuit by a woman who claimed his inaccurate forecast caused her a great deal of suffering. She claimed he misrepresented a particularly harsh day in the forecast, and it encouraged her to wear insufficient layers that left her health to the whim of the elements. As a result, the woman caught the flu from the downpour and missed work for four days. Citing lost income, large medication costs, and tremendous anxiety, she sought reparations from the fraudulent weatherman and was amazingly awarded a four-figure settlement! How These Rats Save Lives

MEET THE RATS THAT SNIFF OUT LAND MINES

HEROISM FROM AN UNEXPECTED SOURCE

W hen you think of animals that could be considered heroic, giant rats probably aren’t the first creatures that pop into your head. Many people still think of them as filthy, disease-ridden little thieves that deserve eradication rather than a medal. But one nongovernmental organization (NGO) has proven just how heroic rats can be by training them to detect land mines and, in turn, save lives.

Tanzania-based NGO APOPO found the answer: African giant pouched rats. These rats have several advantages over dogs and humans when it comes to detecting land mines. While they are bigger than your average pet rat — some can be as large as a cat — they’re still light enough that they won’t detonate a land mine if they stand on one. Though they have poor eyesight, they make up for that deficiency with an incredible sense of smell. A fully trained rat can sniff amounts of TNT as small as 29 grams and distinguish it from other industrial substances like motor oil and battery acid. Along with these innate qualities, pouched rats are easy and cheap to train. While a dog can only bond with and work for one master, rats will sniff out land mines under any person’s direction, so long as they get a tasty treat afterward. They can search a 2,000 square foot area in 20 minutes, saving humans from days of dangerous, meticulous work. Between 1995 and 2015, APOPO’s rats found about 13,200 mines in Africa and Southeast Asia. Today, their programs are still going strong, proving that heroism can be found in even the most unlikely of animals.

Over 60 countries worldwide still feel the effects of wars past every time someone steps on an unactivated land mine. Dogs and metal detectors have traditionally been used to find and safely detonate land mines in these countries, but both methods are costly and time-consuming. A human with a metal detector could take up to four days to clear a 2,000 square foot area of any land mines, and people knew there had to be a faster, safer way.
