C. Application . 1. When requesting a change in underlying zoning, an applicant may simultaneously request PO District zoning. 2. If a request for PO District zoning is not included in a zoning amendment application, the Planning Commission may add the PO zone to the zoning amendment during the public hearing, by a majority vote. a. Re-notification . If the PO District designation was not requested in the application, but was added during the public hearing, re-notification for an additional public hearing is not required.

120 PO Protective Overlay District A. Intent. This district is intended to: 1. Ensure compatibility among potentially incompatible land uses. 2. Ease the transition from one zoning district to another. 3. Address sites or land uses with special requirements. 4. Guide development of unusual situations or unique circumstances. B. Requirements . 1. The requirements of Zoning Regulations Section 5-119 on All Overlay Zoning Districts apply to the PO Protective Overlay District. 2. The PO Protective Overlay District must always be a more restrictive designation than the underlying district, limiting specific uses or requiring more restrictive development standards, for individual projects or specific properties in the underlying zoning district. 3. Restrictions and conditions imposed by the PO District include but are not limited to the following: a. Prohibiting otherwise permitted or special or conditional uses and accessory uses. b. Decreasing the number or average density of dwelling units that may be constructed on the site. c. Increasing minimum zoning lot size or zoning lot width. d. Increasing minimum setback requirements in any yard. e. Placing restrictions on access to abutting properties and streets, including restricting specific design features. f. The Planning Commission may attach conditions to the approval of a PO District, including but not limited to restrictions on hours of operation, lighting, and outdoor activities.
