3. A PUD District must not: a. Substantially diminish or damage the use, value and enjoyment of surrounding property , or hinder the surrounding property's development in accordance with the Comprehensive Plan. b. Impose an undue burden on public services and facilities , such as fire and police protection or utilities. 4. A PUD District may allow any uses consistent with the purposes of the approved Preliminary PUD Plan. 5. A PUD District may require more or less restrictive development standards than its underlying zoning districts. a. A PUD District may broaden or restrict requirements for: (1) Permitted, special?, conditional?, accessory, and temporary uses. (2) Permitted home occupations. (3) Sign requirements. (4) Parking & loading requirements. (5) Access to abutting properties and streets. b. A PUD District may establish maximum or minimum requirements for: (1) Setbacks in any yard. (See definition of SETBACK LINE.) (2) Lot size. (3) Lot coverage.
122 PUD Planned Unit Development Overlay District A. Intent. A Planned Unit Development (PUD) is an OVERLAY ZONING DISTRICT, intended to allow the requirements of its underlying zoning districts to be adapted for a specific development project, in order to: 1. Encourage innovative, coordinated land uses . 2. Allow phased development over time, under the Zoning Regulations in effect at the time of the PUD approval. 3. Allow for commonly owned open space , with provisions guaranteeing its long-term maintenance. 4. Protect environmentally sensitive areas , especially waterways and riparian areas, from inappropriate development. B. General Requirements . 1. The requirements of Zoning Regulations Section 5-119 on All Overlay Zoning Districts apply to the PUD Planned Unit Development Overlay District. 2. A PUD District must : a. Be consistent with the intent and purpose of Andover's current Comprehensive Plan . b. Comply with Andover's Site Plan Review and approval process. c. Contain provisions that ensure the PUD's welfare, and are consistent with the area's best interests, including adequate easements for current and future utilities. d. Maintenance Covenants. Incorporate covenants which provide for long-term maintenance of common open spaces within the development, and should the property owners or owners association fail to properly maintain common open spaces, for enforcement by the City .
