H. Modifications to Preliminary PUD Plan. 1. From the date the approved Preliminary PUD Plan and its establishing ordinance are filed with the County Register of Deeds until an application for a Final PUD Plat is filed, an approved Preliminary PUD Plan must not be modified, revoked, or otherwise impaired by action of the City , unless the developer has either: a. Accepted any proposed alterations, restrictions or conditions. b. Defaulted on or violated any of the conditions of the Preliminary PUD Plan's approval. I. Preliminary PUD Plan Amendments. An approved Preliminary PUD Plan may be amended using the same procedures as for any amendment to the Zoning Regulations (see Zoning Regulations, Section 12-100, on Amendments) , with the following exceptions : 1. An application to amend all or a phase of an approved Preliminary PUD Plan must be signed by the owners or authorized agents of all parcels that will be directly affected by the amendment. 2. PUD Notification Area Exception. Instead of using the notification area as described for other zoning amendments in Section 11-103D of these Zoning Regulations, notification for an amendment to a Preliminary PUD Plan must be provided to all owners of real property which meets any of the following conditions. a. Any part of the property is within the proposed PUD amendment area. b. For a proposed PUD AMENDMENT AREA LESS THAN OR EQUAL TO 20 ACRES — Any part of the property is within 500 feet of the perimeter of the proposed amendment area, or within 200 feet of the perimeter of the PUD District, whichever is less. (See following PUD Notification Area Diagrams.)

c. For a proposed PUD AMENDMENT AREA GREATER THAN 20 ACRES — Any part of the property is within 1,000 feet of the perimeter of the proposed amendment area, or within 200 feet of the perimeter of the PUD District, whichever is less. (See following PUD Notification Area Diagrams.) d. If any part of the proposed PUD AMENDMENT AREA IS LESS THAN 1000 FEET FROM THE CITY LIMITS — Any part of the property is within the unincorporated area and within 1,000 feet of the perimeter of the proposed amendment area, or lies between the amendment area and the points where the 1000-foot line meets the city limits line. (See following PUD Notification Area Diagrams.)
