E. Zoning Permits Required. 1. For zoning permits required for accessory structures and uses and temporary structures and uses , see Zoning Regulations, Article 7. 2. For zoning permits required for off-street parking and loading , see Zoning Regulations, Article 6. 3. For signs which require zoning permits, see Zoning Regulations, Article 8. 4. A zoning permit is required for a site located in a 1% annual chance floodplain , and which would result in an increase in flood levels. (See definition of FLOODPLAIN, and Andover's current Floodplain Management Regulations.) 5. A zoning permit may be required for initial grading or excavation of a proposed construction site. F. Easements and Utilities. 1. No principal or accessory building, structure or use is permitted to locate on or project over any platted or recorded public easement , or over any known utility installation , with the following exceptions. a. Exception: A sign, as permitted by Article 8 of these Zoning Regulations. b. Exception: An accessory structure or use which is moveable, relocatable, or poses no significant problem to maintenance of existing public improvements or to future improvements. c. Exception: Fences may cross easements, as long as provisions for utility access are provided and maintained.

2. Ground level extensions , such as concrete slabs or fences, are not permitted in or on a public easement , except as extensions of permitted parking spaces, driveways or sidewalks. a. If g round level extensions which are located on or project over a public easement are damaged or demolished during required maintenance or improvement projects by the City or a utility company, the property owner is liable for any necessary reconstruction or replacement . 102 Occupancy Certificates A. Zoning Permits and Occupancy Certificates. 1. Every application for a zoning permit is also an application for an occupancy certificate . a. The Zoning Administrator will establish a procedure for applying for an occupancy certificate when no zoning permit is required. 2. A Zoning Permit is a certificate issued by the Zoning Administrator certifying that a proposed structure or use conforms with these Zoning Regulations. (See definition of ZONING PERMIT.) 3. An Occupancy Certificate is a certificate issued by the Zoning Administrator certifying that a completed structure or use complies with these Zoning Regulations, and therefore may be occupied or used . (See definition of OCCUPANCY CERTIFICATE.) 4. The City may issue zoning permits and occupancy certificates concurrently with building and occupancy permits required by City building codes.
