D. Remedies. 1. City of Andover authorities may institute injunction, mandamus, or other appropriate actions, proceedings, or remedies to prevent, correct or abate any violation of these Zoning Regulations, or to prevent the occupancy of a building, structure or land in violation. 2. Any person whose property's value or use is or may be affected by a zoning violation, has the authority to implement suits or actions in any court of competent jurisdiction, in order to enforce these Zoning Regulations and abate nuisances which are zoning violations. E. Floodplain Violations. Any person, company, corporation, institution, municipality or agency of the state that violates any provision of Andover's current Floodplain Management Regulations is subject to: 1. The penalties and remedies provided in Sections 10-104C and D above. 2. Remedies that may be instituted by the Kansas Attorney General, and the Chief Engineer of the Division of Water Resources of the Kansas State Board of Agriculture.
105 Fees A. The Applicant must pay the City Clerk a fee, as determined in the fee schedule approved by the Governing Body, when applying for a zoning amendment, special use, conditional use, variance, administrative adjustment, appeal, or a zoning permit/occupancy certificate. 1. Fees associated with these Zoning Regulations are intended to help defray the costs of administration and enforcement, including publication costs. 2. Fees are not refundable. 3. See Chapter 1.3.6 for current Fees. 106 Reports A. Periodically, the Zoning Administrator must report verbally or in writing to the Governing Body and the Planning Commission, providing a summary of Andover zoning activity during the preceding period, including: 1. A summary of all zoning permits issued during the preceding period, giving details of any permitted variations. 2. The current status of all applications in process for amendments, special uses, appeals, conditional uses and variances. 3. Comments on any problems encountered in the administration or enforcement of these Zoning Regulations. a. Such comments may be particularly useful for the Planning Commission's annual public review in September, as established in Section 13-100 of these Zoning Regulations.
