B. A copy of the notice of hearing must be mailed to : 1. Each party making the appeal. 2. The Secretary of the Planning Commission. C. Notice to Property Owners. The BZA must provide notice of the hearing to all owners of record of any land located within the notification area surrounding the subject property. 1. See the following Section 11-103D for Notification Area descriptions and diagrams. 2. The Applicant must provide a list of all owners of record of land within the notification area to the City, including their addresses and zip codes. 3. The notice of hearing to property owners must be mailed so that at least 20 days elapse between the mailing date and the hearing date. 3. After such a notice to a property owner has been properly addressed and deposited in the mail, failure to receive it does not invalidate any subsequent action taken by the BZA. 4. If a quorum is not present at the time of the hearing, BZA members in attendance may agree to hold another hearing on the property in question, at a future date, time and place. a. When the date, time and place for the future hearing is announced at the present meeting, no further public notice need be given.
102 Jurisdiction A. The BZA is a quasi-judicial body, with jurisdiction and author- ity to hear and decide on: 1. Variances from specific terms of these Zoning Regulations, subject to procedures and standards set out in Section 11-106 of these Zoning Regulations. 2. Conditional uses as exceptions , subject to procedures and standards set out in Section 11-107 of these Zoning Regulations. 3. Appeals of decisions or determinations made by the Zoning Administrator, subject to procedures and standards set out in Section 11-108 of these Zoning Regulations. 103 Notice of Hearing A. Publish Public Notice. Any variance, conditional use, or appeal of a Zoning Administrator decision must have a hearing before the BZA, and a public notice of the hearing must be published in the official newspaper . 1. At least 20 days must elapse between the date of publication and the date of the hearing. 2. The notice of hearing must include: a. Date, time and place of the hearing. b. Legal description of the property under consideration, or a general description sufficient to identify the property.
(1) When only a general description of the property is provided in the notice, the notice must include a statement that a complete legal description is available for public inspection, and must indicate where that information is available.
c. Brief description of the subject of the hearing.
