I. Report by Planning Commission to Governing Body. The Planning Commission must submit a report to the Governing Body within 14 days after the close of a public hearing on a proposed amendment. 1. The report must contain: a. A statement on the purpose and effect of the proposed amendment . b. A summary of the hearing on the proposed amendment. d. Determinations on the factors listed in Section 12-100G of these Zoning Regulations, and on such other items as the Commission may consider relevant. (1) Include a copy of the Zoning Administrator's Report on factors. e. A recommendation for approval or disapproval of the proposed amendment. 2. Copies of the report. a. A copy of the report must be mailed to the Applicant. b. Copies must be filed with the City Clerk and with the Zoning Administrator. These copies must be available for public inspection.
101 Special Uses A. A special use is a use of a structure or land which is not permitted outright within a zoning district because of characteristics that might have an adverse affect on nearby properties or on the future development of the district, but which may be permitted as a special use under specific conditions which make the use suitable for the district and compatible with other designated uses. 1. Special uses are often large, one-of-a-kind, private or public uses serving the community as a whole, or uses whose location has planning implications for a neighborhood or the entire City. 2. A special use must comply with the minimum requirements for all similar permitted uses in the same zoning district, unless a specific reference in these Zoning Regulations reduces those requirements. B. Conditions. Requirements may be more stringent if there is potential for effects which are injurious to other property or the neighborhood, or contrary to public welfare and convenience. 1. Conditions may be placed on the property which is the subject of the special use application, on the Applicant , or on both , and attached to the Planning Commission's recommendation for approval to the Governing Body.
