101 Zoning of Annexed Land A. Annexed Land.

102 General Requirements for All Zoning Districts A. Uses. Uses of land or structures in each zoning district are categorized as Permitted, Special, or Conditional Uses . Zoning districts may also have "Uses Not Permitted" or "Use Limitations". 1. Use requirements apply when structures are built, moved or structurally altered, and when structures or land are used, occupied or designed for use or occupancy. 2. Permitted Uses. Uses permitted as of right in a zoning district. 3. Special Uses. Uses permitted only if they are first approved in the same manner as an amendment to a zoning district. (See Zoning Regulations, Section 12-101.) a. Any conditions imposed on a special use must be included in the effectuating ordinance. 4. Conditional Uses. Each zoning district's conditional uses are permitted or allowed to be changed to another conditional use only if they are first approved by the Board of Zoning Appeals. (See Zoning Regulations, Section 11-107.) 5. Uses Not Permitted. Uses which are not permitted under any circumstances. 6. Use Limitations. Permitted, special and conditional uses within a zoning district must not conflict with the district's use limitations. a. Permitted, special or conditional uses already established on the effective date of these Zoning Regulations must not be altered, extended or enlarged so as to conflict, or further conflict, with the district's use limitations. (See Zoning Regulations, Section 9-102 for Nonconforming Structures, Section 9-103 for Nonconforming Uses, and Section 9-105 for Status of Existing Special and Conditional Uses.)

1. All land annexed to the City retains its existing County zoning classification until an application to consider a change in zoning district is filed by the property owner, Planning Commission, or Governing Body, and approved. a. Exception: When annexed, single-family residential lots platted and recorded with an average lot size of 20,000 square feet or more must be automatically classified in the SF-1 Single-family Residential/Low Density District . b. Exception: When annexed, single-family residential lots platted and recorded with an average lot size of less than 20,000 square feet must be automatically classified in the SF-2 Single-family Residential/Medium Density District . 1. A change in zoning district classification may be considered during the process of annexation. 2. The Planning Commission may hold their required public hearing on a rezoning amendment prior to annexation. However, the annexation ordinance must be effectuated before or at the same time as a separate ordinance approving the rezoning amendment is effectuated. (See 12-100H Table for Comparability of Zoning Districts.)
