ARTICLE 13. REVIEWS, SEVERABILITY & EFFECTIVE DATE 100 Annual Review A. The Planning Commission must hold a public review of these Subdivision Regulations at its regular meeting each January, to consider any needed amendments. 1. Notice of the public review may be distributed to governmental agencies and interested parties. 2. Between reviews, the Subdivision Administrator must maintain a list of suggested amendments. 101 Judicial Review A. Any ordinance, regulation or decision provided for or authorized by these Subdivision Regulations must be reasonable. (See K.S.A. 12-760 et seq. ) 1. Any aggrieved person may bring a legal action in the Butler County District Court against the City, to have the reasonableness of a subdivision regulation decision determined. a. Action must be brought within 30 days after a final decision is made by the City.
102 Severability A. If any provision of these Subdivision Regulations is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, then the unconstitutional or invalid provision must be considered separately and apart from the remaining provisions of these Subdivision Regulations. 1. Provisions held unconstitutional or invalid are completely severable, and the remaining provisions of these Subdivision Regulations remain in full force and effect. 103 Effective Date A. These Subdivision Regulations take full force and effect on the date their adopting ordinance is published in the official city newspaper. 1. These Subdivision Regulations must be adopted by the Planning Commission, and approved by the Governing Body. 2. The adopting ordinance must incorporate these Subdivision Regulations by reference.
