Shared debt, like your property, will have to be divided when you divorce. In every divorce some kind of plan to deal with fa- mily debts, such as balances on joint cre- dit cards, mortgages, car loans, and even unpaid parking tickets, will have to be made. This can require a thorough review of a couple’s financial history and a nego- tiation of how it should be equally divi- ded. In an emotionally difficult situation, it’s often in everyone’s best interest to seek legal representation.
Often, the spouse who originally incurred the debt will be responsible for it after the divorce. Over years of marriage, however, it can be difficult to determine which par- tner incurred the debt, and much of it may have been incurred jointly.
